| Abstrak (Bhs. Indonesia) | Keadilan restoratif diatur dalam Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak. Akan tetapi, Undang-Undang Nomor 3 Tahun 1997 Tentang Pengadilan Anak belum mengaturnya. Walaupun dimungkinkan dalam praktiknya hakim dapat menggunakan prinsip keadilan restoratif ini sebagai ide dalam pertimbangannya untuk menjatuhkan putusan, khususnya terhadap anak sebagai pelaku tindak pidana. Tujuan dari penelitian ini adalah untuk mengetahui penerapan prinsip keadilan restoratif oleh hakim sebelum dan sesudah berlakunya Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak sekaligus untuk mengetahui pengaruh penerapan prinsip keadilan restoratif terhadap pendidikan anak sebagai pelaku tindak pidana. Metode penelitian yang digunakan adalah yuridis sosiologis, spesifikasi penelitian adalah deskriptif, sumber data yang digunakan adalah data primer dan data sekunder, metode pengumpulan data adalah wawancara dan studi kepustakaan dan metode analisis data menggunakan kualitatif. Dari hasil penelitian, dapat disimpulkan bahwa sebelum berlakunya Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak, ide keadilan restoratif tidak tampak dalam putusan, tetapi ide keadilan restoratif ada di dalam pemikiran hakim anak Pengadilan Negeri Purwokerto untuk memperhatikan kesejahteraan anak sehingga anak sebagai pelaku tindak pidana diputus dengan pidana ringan. Setelah diberlakukannya Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak, hakim anak Pengadilan Negeri Purwokerto telah berupaya menerapkan keadilan restoratif yang diwujudkan melalui diversi sesuai amanat Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak. Keadilan restoratif berpengaruh terhadap pendidikan anak, baik terhadap pendidikan formal maupun pendidikan moral anak. |
| Abtrak (Bhs. Inggris) | Restorative justice was regulated in Law Number 11 Year 2012 on the Juvenile Justice System. However, in Law Number 3 Year 1997 on the Juvenile Court has not been regulate it. Even though it is possible in practice the judges can use this principle of restorative justice as an idea on the consideration to make decisions, especially against children as an offender on a criminal act. The purpose of this research is to know about the application of the principle of restorative justice by the judges before and after the validity of Law Number 11 Year 2012 on the Juvenile Justice System also to know the effect of the principle of restorative justice on the education of children as an offender on a criminal act. The research methods are used is sociological juridical, the research specifications is descriptive, the data source are used is primary data and secondary data, the data collection methods is interview and literature study and the data analysis methods using qualitative. From the results of the research, can be concluded that before the validity of Law Number 11 Year 2012 on Juvenile Justice System, the idea of restorative justice doesn’t appear on the judgement, but the idea of restorative justice are exist in the consideration of the judge of the children in Purwokerto District Court to keep the welfare of children so the children as an offender of criminal act are punished with minor sentences. After validity of Law Number 11 Year 2012 on the Juvenile Justice System, the judges of the children in Purwokerto District Court has attempted to apply the restorative justice which realized through the diversion as mandated by Law Number 11 Year 2012 on the Juvenile Justice System. Restorative justice affects the education of children, both on formal and moral education of children. |
