Indonesia) | ANALISIS NORMATIF KEWENANGAN PEMBINAAN PEGAWAI NEGERI SIPIL Oleh: KARTIKA DEWI E1A010032 ABSTRAK Kewenangan pembinaan PNS dipegang oleh Presiden selaku Kepala Pemerintahan. Wewenang pembinaan PNS merupakan kewenangan Presiden yang tertuang di dalam Peraturan Perundang-undangan yaitu Undang-Undang No. 5 Tahun 2014 Pasal 53. Berdasarkan Undang-Undang No. 5 Tahun 2014 Tentang Aparatur Sipil Negara (ASN) bahwa sistem pembinaan merupakan bagian dalam manajemen Pegawai Negeri Sipil. Pada sistem pembinaan terdapat dua sistem, yaitu sistem karier dan sistem prestasi kerja. Permasalahan yang akan dibahas adalah kewenangan pembinaan Pegawai Negeri Sipil dan kendala setelah berlakunya Undang-Undang No. 5 Tahun 2014 Tentang Aparatur Sipil Negara. Metode penelitian yuridis normatif dengan pendekatan perundang-undangan, dan analisis. Data yang digunakan adalah data sekunder yang berupa peraturan perundang-undangan, buku-buku literatur, dan situs-situs internet. Penelitian ini diperoleh bahwa kewenangan pembinaan PNS dalam Undang-Undang No. 5 Tahun 2014 Tentang ASN telah dijelaskan. Pembinaan PNS merujuk pada Peraturan Pemerintah No. 11 Tahun 2017 Tentang Manajemen PNS. Berdasarkan Peraturan Pemerintah No. 11 Tahun 2017 Tentang Manajemen PNS ini tidak menjelaskan mengenai secara rinci sistem pembinaan PNS yaitu sistem karier dan sistem prestasi kerja, serta Kendala pembinaan PNS dikarenakan masih adanya kekurangan dalam pengawasan terhadap pelaksanaan pembinaan Pegawai Negeri Sipil, serta dalam pembinaan Pegawai Negeri Sipil belum adanya peraturan yang baru secara khusus mengenai pembinaan Pegawai Negeri Sipil. |

Inggris) | THE ANALYSIS OF NORMATIVE AUTHORITY ON THE CONSTRUCTION OF CIVIL SERVANTS BY: KARTIKA DEWI E1A010032 ABSTRACT Authorizes the construction of Civil Servants is held by the President as the head of Government. Authorized construction of the Civil Servants is the President of the authority is contained in Legislation, namely Act No. 5 of 2014 Article 53. Based on Act No. 5 of 2014 on the Civil State Apparatus that is part of the coaching system in the management of Civil Servants. On the system construction of the two systems, i.e. systems of career and work achievement system. Issues that will be discussed is the authority on the construction of civil servant and constraints after the enactment of Act No. 5 of 2014 on the Civil State Apparatus. Research methods with normative juridical approach to legislation, and analysis. The data used are secondary data in the form of legislation, literature books, and internet sites. This research was obtained that authorizes the construction of the Civil Servants in Act No. 5 of 2014 on the Civil State Apparatus have been described. The construction of Civil Servants refer to Government Regulation No. 11 of 2017 on the Management of Civil Servants. Based on Government Regulation No. 11 of 2017 on the Management of Civil Servants is not to explain in detail the system of construction of Civil Servants, namely the system of career and work achievement systems, as well as the constraints of the construction of Civil Servants due to the existence of shortcomings in supervision still towards the implementation of the construction of Civil Servant, as well as in the construction of Civil Servant has not the existence of the new regulation specifically concerning the construction of the Civil Servant.
