| Abstrak (Bhs. Indonesia) | Peristiwa hukum di dalam kehidupan bermasyarakat dapat menimbulkan adanya interaksi, kontak atau hubungan antara satu sama lain. Kontak dapat berarti hubungan yang menyenangkan atau hubungan yang menimbulkan pertentangan atau konflik. Pasal 1365 KUHperdata yang menyatakan bilamana terdapat seseorang yang mengalami kerugian karena akibat dari suatu perbuatan melawan hukum yang dilakukan orang lain terhadap dirinya, orang yang dirugikan tersebut dapat mengajukan gugatan ganti rugi melalui pengadilan. Penelitian ini bermaksud untuk mengetahui pertimbangan Majelis Hakim yang mengabulkan gugatan ganti kerugian akibat dari perbuatan melawan hukum penggelapan dalam jabatan di KSP UTAMA KARYA berdasarkan pasal 1365 KUHPerdata dalam Putusan Pengadilan Negeri Banjarnegara No 4/Pdt.G/2015/PN.Bnr. Penelitian ini merupakan penelitian dengan metode penelitian yuridis normatif dengan pendekatan kasus. Data yang digunakan adalah data sekunder yaitu data yang diperoleh dari bahan pustaka. Metode analisa data menggunakan normatif kualitatif.. Pertimbangan hukum Hakim mengenai perbuatan melawan hukum pada putusan Nomor 4/Pdt.G/2015/PN.Bnr. adalah unsur-unsur dari pasal 1365 KUHPerdata yang sudah terpenuhi sudah tepat untuk dinyatakannya perbuatan melawan hukum dan harus adanya penggantian kerugian yang timbul. Perbuatan melawan hukum yang dilakukan memenuhi unsur melanggar hak subyektif orang lain, bertentangan dengan kewajiban hukum si pembuat, juga bertentangan dengan keharusan yang harus diindahkan dalam pergaulan masyarakat mengenai orang lain atau benda |

Contact can mean a pleasant relationship or a conflicting relationship or conflict. Article 1365 of the Criminal Code which states that if any person suffers a loss due to an unlawful act committed by another person to him or her, the aggrieved person may file a lawsuit by court. This research intends to know the consideration of the Panel of Judges who granted compensation claims resulting from the act against the embezzlement law in the position of KSP UTAMA KARYA based on article 1365 Civil Code in the Decision of the District Court of Banjarnegara No.4/Pdt.G/2015/ PN.Bnr. This research is a research with normative juridical research method with case approach. The data used is secondary data that is data obtained from library materials. Methods of data analysis using normative qualitative. Judge's legal considerations regarding unlawful acts in decision Number 4 / Pdt.G / 2015 / PN.Bnr. Are the elements of article 1365 of the Civil Code which have been fulfilled is appropriate for the declared act against the law and there should be compensation for the losses arising.
