| Abstrak (Bhs. Indonesia) | Kebutuhan pokok manusia salah satunya adalah air. Namun dalam pelaksanaan penyediaan air bersih sendiri sering terjadi permasalahan yang merugikan konsumen. Perlindungan hukum merupakan salah satu upaya agar tujuan hukum dapat tercapai. Tujuan hukum yang dimaksud yaitu terpeliharanya keamanan dan ketertiban sehingga dapat menjamin kepastian hukum, dengan demikian dapat menghindarkan tindakan pelaku usaha yang melalaikan kewajibannya. Tujuan penelitian ini adalah untuk mengetahui bagaimana perlindungan hukum bagi konsumen layanan air dari PT. Aetra Air Jakarta berdasarkan Undang - Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dalam Putusan No.006/A/BPSK-DKI/XII/2012. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan undang-undang yang bersifat deksriptif analitis. Sumber data dalam penelitian ini menggunakan data sekunder dari bahan kepustakaan. Metode analisis data yang digunakan ialah metode normatif kualitatif. Hasil penelitian menunjukkan bahwa selama ini pelaku usaha tidak memenuhi hak konsumen khususnya hak konsumen yang diatur di dalam Pasal 4 huruf c UUPK yaitu hak atas informasi yang benar, jelas, dan jujur mengenai biaya yang seharusnya dibayarkan serta Undang-undang No.8 Tahun 1999 tentang Perlindungan Konsumen Pasal 4 huruf d yaitu hak untuk didengar pendapat dan keluhannya selaku pelanggan ia tidak pernah menunggak air. PT. Aetra Air Jakarta juga melanggar kewajibannya sebagai pelaku usaha, khususnya kewajiban yang terdapat dalam Undang-undang No.8 Tahun 1999 tentang Perlindungan Konsumen Pasal 7 huruf b yaitu memberikan informasi yang benar, jelas, dan jujur mengenai biaya yang seharusnya dibayarkan serta Pasal 7 huruf c yaitu tidak memperlakukan atau melayani konsumen secara benar. |
| Abtrak (Bhs. Inggris) | A basic requirement of human one is water. However, in the implementation of the provision of clean water often occurs a problem that harms consumers. Legal protection is one of the effort so that the aim of the law can be achieved. The purpose of the law in question, namely the rights of security and public order so as to guarantee legal certainty, thus can avoid a trade action for neglecting its obligations. The purpose of this research was to know how legal protection for consumers of water services from PT Aetra Air Jakarta based on Law Number 8 Of 1999 about Consumer Protection in Ruling No. 006/A/BPSK-DKI/XII/2012. This research method using normative juridical approach to legislation that is analytical deksriptif. The source of the data in this study uses secondary data from libraries. Methods of data analysis used is the normative qualitative methods. The results showed that during this trade does not meet particular consumer rights consumer rights regulated in article 4 letter c in Law Number 8 of 1999 about Consumer Protection, namely the right to truthful information, clear and honest about the costs that should be paid as well as Law Number 8 Of 1999 about Consumer Protection article 4 letter d, namely the right to be heard and opinions the complaint as the customers he never behindhand the water. PT Aetra Air Jakarta also violated its obligations as businessmen, in particular the obligations contained in Law Number 8 Of 1999 about Consumer Protection article 7 letter b that is giving the correct information, clear and honest about the costs that should be paid as well as article 7 letter c that is not treated or serve consumers correctly. |
