| Abstrak (Bhs. Indonesia) | ABSTRAK Hak untuk mendapatkan bantuan hukum bagi tesangka yang tidak mampu seringkali terabaikan. Mereka yang tidak mampu khususnya di wilayah Bantul biasanya memilih untuk menghadapi sendiri masalah hukumnya tanpa di dampingi oleh advokat. Peraturan mengenai bantuan hukum sebenarnya sudah di atur didalam Undang-Undang Nomor 16 Tahun 2011. Bagi tersangka yang tidak mampu dapat mengakses bantuan hukum secara cuma-Cuma. Rumusan masalah ini untuk mengetahui dan menganalisis bantuan hukum oleh advokat terhadap tersangka yang tidak mampu dalam proses penyidikan di wilayah polres bantul dan menganalisis hambatan yang ada di dalam pemberian bantuan hukum oleh advokat terhadap tersangka yang tidak mampu dalam proses penyidikan di wilayah polres bantul. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis sosiologis dan mengunakan spesifikasi penelitian deskriptif. Lokasi penelitian dilakukan di Polres Bantul. Jenis dan sumber data yang digunakan adalah data primer dan data sekunder. Metode pengumpulan data primer dengan cara wawancara sedangkan pengumpulan data sekunder melaui studi kepustakaan. Berdasarkan penelitian, pemberian bantuan hukum terutama terhadap terangka yang tidak mampu di wilayah Polres Bantul sudah dilakukan sesuai ketentuyan yang berlaku. Namun sebagai besar tersangka yang tidak mampu memilih menolak ketiak diberikan tawaran untuk didampingi penasehat hukum oleh penyidik. Hal ini disebabkan kurangnya pengetahuan masyarakat di daerah Kabupaten Bantul tentang adanya program bantuyan hukum yang dapat diakses secara cuma-cuma bagi mereka yang tidak mampu. | Abtrak (Bhs. Inggris) | ABSTRACT Rights to get the law advice for the suspects which cannot afford sometimes disregarded. They which cannot affordable specifically in Bantul district usually choose to face the problem alone without advocate accompany. Regulation about law advice actually has been arrange in the Laws Number 16th year of 2011. For the suspects which cannot access the law advice for free. The research topic to know and analyse law advice by the advocate into suspects which cannot afford in the investigation process in Bantul Police Resort District and analyse the obstacles which law advice given by the advocate through the suspects that cannot afford the investigation process in Bantul Police Resort District. Approach Method that used in this research is sociology juridical and used the descriptive research specification. Research location has been done in Bantul Police Resort District. Kind and data source that been used are primary and secondary data. The data primary accumulation methods use the interview meanwhile the data secondary accumulation used literature study. Based on the research, the law advice given firstly toward the unaffordable suspects in Bantul Police Resort District has been done according the valid rules. But, most of unaffordable suspects choose the refuse when the offer has given for accompanied by the law advisor from investigator. This case caused the lack of society knowledge in Bantul Regency area about the law advice programme which can be access for free into the unaffordable peoples.
