| Abstrak (Bhs. Indonesia) | Penelitian ini mengambil judul Tindak Pidana Kemilikan Satwa Liar Yang Dilindungi Undang-Undang (Studi Putusan Pengadilan Negeri Nganjuk Nomor 317/Pid. Sus/2013/PN. Njk). Metode pendekatan yang dipakai adalah yuridis normatif yaitu suatu penelitian yang menekankan pada ilmu hukum, di samping itu juga berusaha menelaah kaidah-kaidah hukum yang berlaku di masyarakat. Spesifikasi Penelitian yang digunakan adalah deskriptif analitis yaitu penelitian yang menggambarkan keadaan objek yang akan diteliti untuk kemudian dianalisis berdasarkan teori-teori hukum dan praktik pelaksanaan hukum positif yang menyangkut permasalahan tanpa maksud untuk mengambil kesimpulan-kesimpulan yang berlaku umum. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa Perbuatan terdakwa P.U telah terbukti secara sah dan meyakinkan, serta memenuhi unsur-unsur sebagaimana dirumuskan Pasal 21 ayat (2) huruf a jo Pasal 40 ayat (2) Undang-Undang Nomor 5 Tahun 1990 Tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya. Dasar Pertimbangan Hukum Hakim dalam menjatuhkan pidana dalam Putusan Perkara Nomor 317/Pid.Sus/2013/PN.Njk, yaitu terpenuhinya unsur-unsur Pasal 21 ayat (2) huruf a jo Pasal 40 ayat (2) Undang-Undang Nomor 5 Tahun 1990 Tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya, adanya pembuktian berdasarkan alat-alat bukti yang diatur dalam Pasal 184 KUHAP dan diperkuat dengan barang bukti yang diajukan kepersidangan dan adanya hal-hal yang memberatkan dan meringankan ancaman pidana terhadap Terdakwa PU. | Abtrak (Bhs. Inggris) | ABSTRACT This study entitled "Crime ownership Protected Wildlife Act (Study Nganjuk District Court's Decision No. 317 / Pid. Sus / 2013 / PN. Njk)". The method used in this research is normative juridical approach with an analytical approach. This study comes on secondary data obtained from the legislation, literature books, papers, documents and official papers that had to do with the object of research. The population of protected animals endangered, making the government published legislation for the protection of endangered species and extinction. Prohibition of possession of protected species regulated in Law No. 5 of 1990 on Conservation of Natural Resources and Ecosystems in Article 21 paragraph (2) letter a formulating any person is prohibited to catch, injure, kill, keep, possess, maintain, transport and memperniagakan protected animals alive. In connection with the formulation of Article 21 paragraph (2) letter a of Law No. 5 of 1990 on Conservation of Natural Resources and Ecosystems was contained elements that whoever, intentionally, capture, injure, kill, keep, possess, maintain, transport and memperniagakan protected animals, alive. Based on the results of research on Nganjuk District Court No. 317 / Pid. Sus / 2013 / PN. NJK, indicating that the defendant has been proven legally and convincingly meets the elements of Article 21 paragraph (2) letter a of Law No. 5 of 1990 on Conservation of Natural Resources and Ecosystems. It is by basing on juridical facts revealed at the hearing and is reinforced by the opinions of the scholars. The next consideration is the fulfillment of valid evidence under Section 184 Criminal Procedure Code, and the consideration of things that are burdensome and relieve the defendant, it is governed by Article 197 f of the Criminal Procedure Code. Therefore, the judge ruled against the defendant's sentencing form of imprisonment for 4 months. Keywords: Crime, ownership, Wildlife. |
