| Abstrak (Bhs. Indonesia) | Pasal 1 angka (1) Perma No. 2 Tahun 2015 Tentang Tata Cara Penyelesaian Gugatan Sederaha menyatakan,“Penyelesaian gugatan sederhana adalah tata cara pemeriksaan di persidangan terhadap gugatan perdata dengan nilai gugatan materil paling banyak Rp 200.000.000,00 (dua ratus juta rupiah) yang diselesaikan dengan tata cara dan pembuktiannya yang sederhana.” Penelitian ini bertujuan untuk mengetahui pertimbangan hukum hakim mengabulkan gugatan sederhana terhadap Putusan Nomor: 01/Pdt.G.S/2016/PN Pwd, serta perbedaan antara Gugatan sederhana dan gugatan biasa/gugatan konvensional. Metode pendekatan penelitian ini adalah yuridis normatif. Hasil penelitian yang diperoeh yaitu; (1) Hakim mengabulkan gugatan sederhana dalam Putusan Nomor : 01/Pdt.G.S/2016/PN Pwd mengenai gugatan Para Penggugat memenuhi syarat gugatan sederhana sebagaimana ketentuan Perma No. 2 Tahun 2015 Tentang Tata Cara Penyelesaian Gugatan Sederhana, mengabulkan gugatan Para Penggugat yang menyatakan Para Tergugat melakukan Wanprestasi karena Para Penggugat berhasil membuktikan adanya peristiwa utang piutang dan wanprestasi, serta hakim tidak cermat dalam pertimbangan hukum hakim atas pemeriksaan secara contradictoir dan vertsek, yang semestinya diputus secara contradictoir, dan; (2) Perbedaan utama gugatan sederhana dan gugatan biasa/gugata konvensional terletak pada dasar hukumnya yaitu, gugatan sederhana berdasar Perma No. 2 Tahun 2015 Tentang Tata Cara Penyelesaian Gugatan Sederhana dan HIR, sedangkan gugatan sederhana mendasakan pada HIR, RBG, RV. This study aims to determine the legal considerations of the judges in favor of the simple against Decision No. 01/ Pdt.G.S/2016/PN Pwd, and the difference between simple and tort lawsuit regular/conventional lawsuit. This research a methods approach is normative. The results of research obtainable namely; (1) The judge in favor of simple in its Decision No. 01 / Pdt.G.S / 2016 / PN Pwd on the lawsuit Plaintiffs claim qualifies simple as the provisions Perma No. 2 Tahun 2015 Tentang Tata Cara Penyelesaian Gugatan Sederhana, in favor of the plaintiff that states the Defendants conduct of Default for Plaintiffs successfully proving their events debts and default, and judges are not careful in the legal considerations judge on examination contradictoir and vertsek, which should be disconnected contradictoir basis, and; (2) The main difference is simple tort and tort regular / conventional gugata lies in its legal basis, namely, the simple suit based Perma No. 2 Tahun 2015 Tentang Tata Cara Penyelesaian Gugatan Sederhana and HIR, whereas a simple lawsuit based on HIR, RBG, RV.
