| Abstrak (Bhs. Indonesia) | ABSTRAK Penelitian ini mengambil judul “EKSEPSI YANG DIKABULKAN (Studi Putusan Pengadilan Negeri Surabaya Nomor 939/Pdt.G/2015/PN/Sby)”, yang bertujuan untuk mengetahui pertimbangan hukum Hakim Pengadilan Negeri Surabaya dalam mengabulkan eksepsi yang diajukan Tergugat karena gugatan obscuur libel dan plurium litis consortium. Penelitian ini menggunakan metode pendekatan hukum secara normatif dan spesifikasi penelitian deskriptif. Dalam penelitian ini sumber data yang digunakan adalah data sekunder berupa Putusan Pengadilan Negeri Surabaya Nomor 939/Pdt.G/2015/PN.Sby, peraturan perundang-undangan, buku-buku literatur yang berkaitan dengan permasalahan penelitian. Data yang diperoleh disajikan secara logis dan sistematis, dan analisis data dilakukan secara normatif. Adapun hasil yang diperoleh penulis melalui penelitian ini, Hakim mengabulkan eksepsi Tergugat terhadap perkara pembagian harta bersama pada prinsipnya bukan merupakan penolakan terhadap pokok perkara, akan tetapi karena gugatan mengandung cacat formil sehingga perkara tersebut dihentikan dan putusan belum menyangkut pada pokok perkaranya. Terhadap putusan ini, gugatan yang diajukan oleh Penggugat kabur (obscuur libel) karena Penggugat tidak menyebutkan objek sengketa secara rinci dan gugatan kurang pihak (plurium litis consortium) karena tidak memasukkan pihak yang dimaksud yang menguasai objek sengketa. Dasar pertimbangan hukum Hakim telah tepat dan benar, gugatan yang dinilai kabur dan kurang pihak merupakan pertimbangan hukum Hakim dalam menjatuhkan putusan negatif. Inggris) | ABSTRACT This research took the title "Granted Exception (Study of Surabaya District Court's Decision No. 939/Pdt.G/2015/PN/SBY)", which aims to determine the legal considerations in the Surabaya District Court in order to grant the exception submitted in because of obscuur libel and plurium litis consortium. This study uses normative and descriptive specifications as the legal approach. In this study the sources of data used are secondary data from Surabaya District Court's Decision No. 939/Pdt.G/2015/PN.Sby, legislations, books of literature related to research problems. The data obtained are presented in a logical and systematic, and data analysis are presented normatively. The results obtained through this research is that the principle when Judge granted the Defendant's exception of the case of the division of joint property, is actualy not a rejection regarding the subject matter, however, it is because the lawsuit has legal defect so that the case is terminated and the decision is yet being decisioned regarding the principal of the case. Regarding this decision, a lawsuit filed by the obscure Plaintiff (obscuur libel) is because Plaintiff did not mention the object of dispute in detail and there is less party claim (plurium litis consortium) because it does not include the parties referred to the master object of dispute. The Basic legal considerations of the judge has been done appropriately and correctly, the obscure lawsuit considered and less-party represents a legal consideration of the negative decisions by the judge.
