| Abstrak (Bhs. Indonesia) | Skripsi ini berjudul : “Kedudukan Panitia Pemilihan Kepala Desa Sebagai Subjek Hukum Tergugat di Pengadilan Tata Usaha Negara (Studi Terhadap Putusan Pengadilan Nomor 17/G/2013/PTUN.YK)”. Penelitian ini akan menguraikan apakah Panitia Pemilihan Kepala Desa dapat dikategorikan sebagai Badan atau Pejabat Tata Usaha Negara. Sumber bahan hukum penelitian ini yaitu Putusan Pengadilan Tata Usaha Negara Yogyakarta Nomor 17/G/2013/PTUN.YK. Penggugat dalam perkara a-quo adalah Ida Ristanti yang merupakan calon kepala desa yang kalah dalam Pemilihan Kepala Desa Hargorejo Kecamatan Kokap Kabupaten Kulon Progo. Tergugat dalam perkara tersebut adalah Panitia Pemilihan Kepala Desa Hargorerjo Kecamatan Kokap Kabupaten Kulon Progo. Objek gugatannya yakni Berita Acara Pemilihan Kepala Desa Nomor : 6/PANPILKADES/IX/2013 tentang hasil Pemilihan Kepala Desa Hargorejo Kecamatan Kokap Kabupaten Kulon Progo. Metode yang digunakan dalam penelitian ini adalah Yuridis Normatif dengan pendekatan yang digunakan adalah pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukan bahwa Panitia Pemilihan Kepala Desa Hargorejo dapat dikategorikan sebagai Badan atau Pejabat Tata Usaha Negara. Majelis Hakim berpendapat bahwa penerbitan objek sengketa dan pelaksanaan Pemilihan Kepala Desa Hargorejo sudah sesuai dengan peraturan perundang-undangan yang berlaku yaitu Peraturan Daerah Kabupaten Kulon Progo Nomor 6 Tahun 2010 dan Peraturan Bupati Kulon Progo Nomor 62 Tahun 2011. Majelis Hakim juga menimbang bahwa Tergugat dalam menerbitkan objek sengketa telah sesuai dengan asas-asas umum pemerintahan yang baik sehingga Majelis Hakim menolak gugatan Penggugat untuk seluruhnya. |

Inggris) | This research has title “Position Village Head Election Committee as Subject Defendant Law on State Administrative Court (Study against Court Decision No. 17/G/2013/PTUN.YK)”. This research will outline whether the Village Head Election Committee can be categorized as an Agency or Officer of the State Administrative. The source of law material from this research is the State Administrative Court Decision in Yogyakarta No. 17/G/2013/PTUN.YK.The plaintiffs in the a quo case is Ida Ristanti who are candidates for village chief who lost from the Village Head Election Hargorejo, Sub district of Kokap,Regency of KulonProgo. The defendant in the suit is the Village Head Election Committee Hargorerjo, Sub District of Kokap, Regency of Kulon Progo. The objects lawsuit is the Village Head Election News Event No: 6/PANPILKADES/IX/2013 concerning the results of the Village Head Election Hargorejo, Sub district of Kokap, Regency of Kulon Progo. The method used in this research is normative juridical, with the approach is used the approach of legislation, case approach, and conceptual approaches. The results of this research shows that the Election Committee Village Head Hargorejo can be categorized as an Agency or State Administrative Officer. The panel of judges found the object of dispute publication and implementation of the Village Head Election Hargorejo are in accordance with the legislation in force, namely Regional Regulation of Kulon Progo Regency No. 6 Year 2010 and Kulon Progo Regent Regulation No. 62 Year 2011. The panel of judges also considered that the Defendant in issuing the object of the dispute is in accordance with the general principles of good governance, so that the panel of judges rejects the Plaintiff's claim in its entirety. |
