| Abstrak (Bhs. Indonesia) | ABSTRAK Tindak pidana yang terjadi saat ini terjadi kecenderungan pelakunya masih tergolong usia anak-anak. Pelaksanaan peradilan pidana anak terdapat fakta bahwa proses pengadilan pidana anak menimbulkan dampak negatif. Maka sebelum masuk proses peradilan, para penegak hukum dan keluarga wajib mengupayakan proses penyelesaian di luar jalur pengadilan melalui diversi. Anak sebagai kajian hukum khusus membutuhkan aparat khusus untuk menyelenggarakan proses peradilan terhadap anak yang berhadapan dengan hukum, salah satunya Balai Pemasyarakatan. Penelitian ini mengambil rumusan masalah: (1) Peran BAPAS dalam proses diversi terhadap tindak pidana yang dilakukan oleh anak di Balai Pemasyarakatan Purwokerto berdasarkan UU Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak; (2) Faktor yang menjadi pendukung dan penghambat BAPAS dalam proses diversi di Balai Pemasyarakatan Purwokerto. Penelitian ini menggunakan metode yuridis sosiologis yang bersifat deskriptif analitis. Sumber data primer berupa wawancara. Data diuraikan dalam bentuk teks naratif. Metode analitis data yang digunakan adalah metode normatif kualitatif. Hasil penelitian ini menyimpulkan: (1) Peran BAPAS dalam proses diversi di Balai Pemasyarakatan Purwokerto terbagi menjadi 3 tahap, yaitu tahap persiapan musyawarah diversi, tahap musyawarah diversi, dan tahap pelaksanaan hasil kesepakatan musyawarah diversi; (2) Faktor pendukung yaitu kerjasama yang baik antara Klien, korban, pihak keluarga, Pembimbing Kemasyarakatan, instansi terkait dan masyarakat dalam proses diversi; sarana yang memadai untuk membantu kelancaran melaksanakan diversi; dan masyarakat bersikap arif terhadap Klien Anak sedangkan faktor penghambat yaitu anggaran dalam pelaksanaan Home Visit untuk proses diversi kurang walaupun sudah disubsidi oleh pemerintah dan pengetahuan masyarakat tentang BAPAS yang masih terbatas. | Abtrak (Bhs. Inggris) | ABSTRACT Criminal act that happens recently that generally the suspect tends to be classified in the children age. The implementation of court for the children criminal act, there is a fact that the court process of children criminal act gives the negative effect. So before enter in the court process, the law officer and families must try to do the solution process in the out of court trough the diversion. The child as the specific law review needs special officers to implement the court process for the children who face the law, one of them is Balai Pemasyarakatan. This research takes the problem formulation: (1) Role of BAPAS in the diversion process to the criminal act that is conducted by children in Balai Pemasyarakatan Purwokerto bases on Ordinance Number 11 in 2012 about the Court System of Children Criminal Act; (2) The factor that become the support and barrier of BAPAS in the diversion process in Balai Pemasyarakatan. This research uses the method of sociological juridical that has the analytic descriptive characteristic. Source of secondary data is interview. Data is explained in the form of narrative text. Method of data analytical uses the method of qualitative normative. The result of this research concludes: (1) The role of BAPAS in the diversion process at Balai Pemasyarakatan Purwokerto is divided into 3 stages, that are preparation stage of diversion discussion, stage of diversion discussion, and stage of result implementation of the agreement result of diversion discussion; (2) Support factor that is good cooperation between the client, victim, family side, Prison Counselor, related department and society in the diversion process; the appropriate infrastructure to help the diversion implementation easiness; and the society has good wisdom for Children client and the barrier factor that is the budget in the implementation of Home Visit or the diversion process is insufficient although it has been subsidized by government and the knowledge of society about the BAPAS that is still limited.
