| Abstrak (Bhs. Indonesia) | Teknik Forensik Hipnotis adalah penggunaan hipnosis sebagai alat bantu dalam melakukan investigasi atau penggalian informasi dari memori. Hipnosis ini biasanya digunakan untuk keperluan penyelidikan di kepolisian. Teknik ini tidak membuat orang yang dihipnotis benar-benar tidak sadar dan tidak berdaya tetapi teknik tersebut membantu orang yang terhipnotis untuk tetap sadar dan membuat lebih fokus dalam berpikir dan mengingat suatu kejadian. Hal ini akan memudahkan tugas penyidik dalam mengungkap tindak kejahatan apa yang terjadi dan siapa pelaku dalam tindak pidana tersebut. Tujuan penelitian ini untuk mengetahui dan menganalisis pembuktian dengan teknik hipnotis yang diterapkan oleh penyidik dalam proses penyidikan pada pengungkapan suatu tindak pidana dan mengetahui kendala pembuktian yang menerapkan teknik hipnotis dalam penyidikan suatu tindak pidana dalam lingkup penyidik kepolisisan. Penelitian ini adalah yuridis sosiologis, metode penelitian secara kualitatif dan menggunakan spesifikasi penelitian deskriptif. Metode pengumpulan data secara interview dan studi pustaka. Hasil penelitian menunjukan, dalam proses penyidikan, penyidik dapat menggunakan teknik Forensik Hipnotis sebagai teknik bantu untuk menemukan alat bukti di tingkat pemeriksaan setelah dilakukan diawal penyidikan sesuai peraturan yang berlaku karena teknik ini tidak serta merta menjadi acuan. Selain itu dalam proses penyidikan, penyidik bisa melakukan gelar perkara untuk menemukan alat bukti baru dan keterangan lain mengenai perkara. Faktor yang menghambat penyidikan teknik Forensik Hipnotis yaitu faktor hukum, penegak hukum, sarana prasarana, masyarakat dan kebudayaan. |
| Abtrak (Bhs. Inggris) | Hypnotic Forensic Technique is the use of hypnosis as a supporting instrument in conducting an investigation or information searching from memory. This hypnosis is usually used for investigation demands in the police. This technique does not totally make the people who are hypnotized feel unconscious or powerless but the technique helps the hypnotized people to remain conscious and make them to focus more on thinking and remembering an incident. It can make the investigator easier in revealing crimes, what happens and who the criminals are. This research is aimed at finding out and analyzing the authentication by using hypnotic technique which is used by the investigator in the process of investigation in disclosing a criminal case and discovering the authentication constraints which use the hypnotic technique in the investigation of a criminal case in the cover of police investigation. This research is judicial sociological, using qualitative research method and descriptive research specification. The methods of data collection are interview and literary study. The result of the research shows, in the investigation process, the investigator can use the Hypnotic Forensic Technique as a supporting technique to find the evidence instrument in an investigation after it is done at the beginning of the investigation according to the valid regulations because this technique does not merely become a reference. Besides, in the process of the investigation, the investigator can conduct a case to find the new evidence instrument and the other information about the lawsuit. The factors that obstruct the investigation of Hypnotic Forensic Technique are the law, marshals, infrastructures, society and culture. |
