| Abstrak (Bhs. Indonesia) | Penelitian ini bertujuan untuk mengetahui apakah penjatuhan pidana terhadap anak pelaku tindak pidana pencurian dengan pemberatan dalam putusan Nomor: 01/Pid.Sus-Anak/2014/PN Bms. tidak bertentangan dengan keadilan restoratif. Penenelitian ini menggunakan metode penelitian yuridis normatif, dengan spesifikasi penelitian tipe deskriptif analitis, lokasi penelitian berada di Pengadilan Negeri Banyumas, di Pusat Informasi Ilmiah Fakultas Hukum Universitas Jenderal Soedirman dan Unit Pelaksana Teknis Perpustakaan Universitas Jenderal Soedirman, jenis data yang digunakan adalah data sekunder, metode pengumpulan data adalah studi kepustakaan.Berdasarkan hasil penelitian syarat-syarat penjatuhan pidana dalam putusan Nomor: 01/Pid.Sus-Anak/2014/PN Bms. adalah dapat di pidananya perbuatan dari anak tersebut dan dapat di pidananya sipembuat.Penjatuhan pidana terhadap anak dalam putusan Nomor: 01/Pid.Sus-Anak/2014/PN Bms bertentangan dengan keadilan restoratif. Inggris) | This research aims to determine criminal punishment against children perpetrators of criminal acts of theft by weighting in decision No.01/ Pid.Sus-Anak/2014/PN Bms. does not conflict with restorative justice. This study was using normative juridical research method, with specification of descriptive analytical study, the study site is located in Banyumas District Court, at the Center of Scientific Information Faculty of Law Jenderal Soedirman University and Technical Implementation Unit Library of Jenderal Soedirman University, the type of data used is secondary data, data collection method is the study of literature. Based on this research the terms of criminal punishment in the decision No. 01/Pid.Sus-Anak /2014/ PN Bms. is can be in criminal act of the Child and the creator can be in criminal. Criminal punishment against children in decision No. 01/Pid.Sus-Anak/2014/PN Bms conflict with restorative justice. Keywords : criminal punishment, children, restorative justice |
