Indonesia) | Pelaksanaan tanggung jawab Pemerintah Indonesia untuk menjamin keterjangkauan harga obat melalui pemenuhan akuntabilitas dan transparansi diwujudkan dengan diberlakukannya Keputusan Menteri Kesehatan No.HK.02.02/MENKES/525/2015 tentang Harga Eceran Tertinggi (HET) Obat Generik, dan Peraturan Menteri Kesehatan No. 98 Tahun 2015 tentang Pemberian Informasi HET Obat, namun dalam pelaksanaannya masih terdapat konsumen yang merasa dirugikan akibat harga jual obat generik lebih tinggi dari HET pada label obat. Oleh karena itu, Pemerintah memberi perlindungan hukum untuk menjamin pemenuhan hak konsumen atas informasi yang benar, jelas dan jujur mengenai harga obat. Tujuan penelitian ini adalah untuk mengetahui bentuk pelanggaran yang dilakukan oleh tenaga kefarmasian di Apotek yang menjual obat generik lebih tinggi dari HET pada label obat, dan bagaimana perlindungan hukum terhadap konsumen obat generik yang dijual di atas HET pada label obat berdasarkan Undang-Undang No. 36 Tahun 2009 tentang Kesehatan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus yang bersifat deskriptif. Sumber data penelitian ini adalah data sekunder dari bahan kepustakaan, didukung dengan data primer yang diperoleh dari kenyataan di lapangan dan wawancara. Data diuraikan dalam bentuk teks yang sistematis. Metode analisis yang digunakan adalah metode normatif kualitatif. Hasil penelitian menunjukan bahwa bentuk pelanggaran yang dilakukan oleh tenaga kefarmasian di Apotek yang menjual obat generik lebih tinggi dari HET pada label obat adalah tidak dilaksanakannya kewajiban untuk memberikan informasi HET obat pada saat penyerahan obat kepada konsumen sebagaimana termasuk dalam standar pelayanan kefarmasian di Apotek, sehingga konsumen merasa dirugikan. Perlindungan hukum terhadap konsumen obat generik yang dijual di atas HET pada label obat dilakukan secara preventif melalui pembinaan dan pengawasan, serta represif melalui pemberian ganti rugi. |

Inggris) | Implementation of the Indonesian Government’s responsibility to ensure the affordability of drugs through the fulfillment of accountability and transparency is realized with the enactment of Minister Decree of Health No.HK.02.02 / Menkes / 525/2015 on Highest Retail Price of Generic Drugs, and the Minister of Health Regulation No. 98 of 2015 on Provision of Drug’s Highest Retail Price Information, but in practice there are consumers who harmed by the sale price of generic drugs is higher than the highest retail price on the drug’s label. Therefore the Government gave legal protection to ensure the fulfillment of the right to get the correct, clear and honest information about drug prices, The purpose of this research was to determine the shape of offenses committed by the pharmacist in the pharmacy that sells generic drugs higher than the highest retail price on drug’s label, and how the legal protection of the generic drugs consumer who sold over the highest retail price on drug’s label under Act No. 36 of 2009 on Health. This research uses a normative approach and case approach. The data source of this research is secondary data from the literature, supported by primary data obtained from the reality and interviews. The data described in systematic text. The analytical method used is a qualitative normative method. The results showed that the shape of violations committed by the pharmacist in the pharmacy that sells generic drugs higher than the highest retail price on the drug’s label is not implementing the obligation to provide information about the highest retail price drug during dispense to consumer that included in the pharmacy service standard in the pharmacy. The legal protection to consumers of generic drugs that sold over the highest retail price on the drug’s label do preventively through guidance and supervision, as well repressive through indemnity. |
