Kemajuan teknologi, khususnya internet, pada satu sisi memberikan banyak kemudahan dan manfaat bagi manusia namun pada sisi lain juga menimbulkan permasalahan baru. E-commerce sebagai suatu bentuk perdagangan yang relatif baru juga tidak lepas dari masalah dalam pelaksanaannya. Penelitian ini ditujukan untuk menganalisa hak dan kewajiban para pihak dalam transaksi e-commerce. Selain itu juga untuk menganalisa perlindungan konsumen terhadap kerugian jual beli online. Untuk mengkaji hal tersebut digunakan metode yuridis normatif. Hasil penelitian menyatakan bahwa, Hak dan kewajiban para pihak dalam transaksi e-commerce, dapat dideskripsikan; Pembeli barang berkewajiban membayar pembelian barang dan ongkos kirim serta berhak mendapatkan barang. Toko online berkewajiban menyediakan Informasi, daftar atau katalog barang, sarana pembayaran, menyediakan kontrak e-commerce, melakukan pembayaran terhadap pengirim serta berhak mendapatkan/ menetapkan biaya periklanan dari penjual dan mendapatkan biaya komisi dari sarana pembayaran. Penjual berkewajiban memberikan dengan jelas klasifikasi barang, membayar biaya toko online, menyerahkan barang kepada toko online, dan berhak mendapatkan uang hasil penjualan, Pengirim berkewajiban mengantarkan barang ke pembeli dan berhak mendapatkan biaya dari toko online. Perlindungan konsumen terhadap transaksi jual beli di Toko Online adalah Perlindungan hak konsumen untuk memperoleh barang sesuai yang dijanjikan penjual dan barang tersebut datang tepat waktu sehingga konsumen tidak perlu menunggu terlalu lama yang pada akhirnya menimbulkan kerugian baik materiil maupun inmateriil. |
