| Abstrak (Bhs. Indonesia) | Penelitian ini bertujuan untuk mengetahui Penyelesaian Pengaduan atas pemberitaan Pers sebelum berlakunya Undang-Undang Nomor 40 Tahun 1999 tentang Pers dan Peran Dewan Pers dalam Penyelesaian Pengaduan atas pemberitaan Pers berdasarkan Undang-Undang Nomor 40 Tahun 1999 tentang Pers. Metode Pendekatan dalam penelitian ini adalah yuridis normative dengan spesifikasi penelitian deskriptif. Metode pengumpulan data yang digunakan adalah studi kepustakaan dan studi dokumen. Data-data yang diperoleh disajikan dalam bentuk teks naratif yang disusun secara sistematis. Metode analisis data yang digunakan yaitu normatif kualitatif. Hasil Penelitian ini menunjukan beberapa hal, Pertama Sebelum berlakunya Undang-Undang Nomor 40 Tahun 1999 tentang Pers, penyelesaian pengaduan atas pemberitaan pers yang berupa pengaduan dugaan pelanggaran kode etik jurnalistik diselesaikan melalui Dewan Kehormatan PWI dan penyelesaian pengaduan atas pemberitaan pers yang berupa pengaduan dugaan tindak pidana pers ataupun gugatan perdata diselesaikan melalui proses pengadilan. Kedua, Setelah berlakunya Undang-Undang Nomor 40 Tahun 1999 tentang Pers, penyelesaian pengaduan atas pemberitaan pers diselesaikan melalui Dewan Pers terlebih dahulu melalui mediasi dan ajudikasi, apabila Pengadu tidak puas dengan hasil penyelesaian Dewan Pers bisa dilanjutkan untuk diproses pidana maupun perdata melalui proses pengadilan. |

Inggris) | This research aimed to determine the Complaint Resolution on press reports prior to the enactment of Law No. 40 of 1999 on the Press and the Role of the Press Council in Complaint Resolution on press report based on Law No. 40 of 1999 on the Press. The Approach Method in this research was normative juridical research with descriptive specification. Data collection method used was literature study and document study. The data obtained was presented in the form of systematically arranged narrative text. The data analysis method used was qualitative normative. The result of this research indicated several things. First, before the enactment of Law No. 40 of 1999 on the Press, complaints resolution on press report in the form of complaints of alleged violations of journalistic ethics resolved through the Honorary Board of PWI (Indonesian Journalists Union) and complaint resolution on press report in the form of complaints of criminal press or civil action settled through the court process. Second, after the enactment of Law No. 40 of 1999 on the Press, complaints resolution of press reports can be resolved through the Press Council, then through mediation and adjudication, if the complainants are not satisfied with the result of resolution by the Press Council, it can be continued to be processed through the criminal and civil process though the court. |
