| Abstrak (Bhs. Indonesia) | Permufakatan Jahat adalah perbuatan dua orang atau lebih yang bersepakat untuk melakukan, tindak pidana,terdakwa telah melakukan tindak pidana jual beli narkotika yang disepakati dengan pelaku yang lain .Tujuan penelitian ini untuk mengetahui pertimbangan hukum Hakim dalam penerapan unsur tindak pidana permufakatan jahat untuk melakukan bisnis narkotika. Metode pendekatan yuridis normatif, spesifikasi penelitian bersifat deskriptif analisis, sumber data sekunder metode studi kepustakaan, buku literatur, dan dokumen resmi . Diketahui bahwa berawal dari perkenalan antara terdakwa dengan Syafrudin telah melakukan jual-beli Narkotika untuk memperlancar jual beli tersebut digunakan beberapa nomor rekening BCA yang dilengkapi dengan fasilitas M-Banking, dengan mempergunakan Hand Phone Perbuatan itu telah memenuhi unsur dalam Pasal 114 ayat (2) jo Pasal 132 ayat (1) Undang-undang No. 35 Tahun 2009 . |
