| Abstrak (Bhs. Indonesia) | ABSTRAK Rumusan negara hukum pada Undang-Undang Dasar 1945 setelah amandemen berbeda dengan kondisi sebelum amandemen yang sekedar tertuang pada bagian Penjelasan dengan bunyi Negara Indonesia berdasar atas hukum (rechtstaat), tidak berdasar kekuasaan belaka (machtstaat). Setelah amandemen pengaturan negara hukum memiliki kedudukan yang lebih kuat dengan diatur pada Pasal 1 ayat (3) yang berbunyi Negara Indonesia adalah negara hukum. Namun demikian, secara akademis rumusan tersebut rawan menimbulkan kerancuan dalam memahami konsep negara hukum seperti apa yang dianut negara Indonesia. Secara praktis, penyelenggaraan kehidupan bernegara sukar fokus pada pencapaian tujuan bernegara bangsa Indonesia yang tertuang pada Pembukaan Undang-Undang Dasar 1945. Penelitian ini bertujuan untuk mengetahui konsepsi negara hukum indonesia setelah amandemen Undang-Undang Dasar 1945 dengan menggali latar belakang perumusan Pasal 1 ayat (3) serta menganalisis negara Indonesia sebagai negara hukum berdasarkan unsur-unsurnya. Metode pendekatan yang digunakan dalam penelitian ini adalah Pendekatan Sejarah (historical approach) dan Pendekatan Konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa rumusan negara hukum pada Pasal 1 ayat (3) sekedar konsekuensi kesepakatan MPR untuk memindahkan kandungan normatif dari Penjelasan menjadi bagian Pasal-perpasal. Kemudian pada analisa unsur-unsur negara hukum ditemukan unsur-unsur yang bersifat umum dan unsur negara hukum khas Indonesia. konsepsi negara hukum Indonesia dapat dipahami dengan berdasarkan pada Pancasila dan Teori Bernegara bangsa Indonesia. Inggris) | ABSTRACT The declaration as the constitutional state in the Constitution of 1945 after amendment be different from the previous which are simply placed on the Explanation of the Constitution sounded Indonesian state based on law (rechtstaat), baseless on power (machtstaat). After amendments, formulation as the constitutional state has a more powerful position to be set in Article 1 verse (3) which reads The Indonesia is a constitutional state. However, these formulations academically prone to cause confusion in understanding what the concept of the constitutional state that adopted by the Indonesian. Practically, the implementation of a national life is difficult to focus on achieving the purpose of the state of Indonesia which written on the Preamble of the Constitution. This study aims to determine the conception of Indonesian as the constitutional state after the amendment of the Constitution of 1945 by dig up the background of the formulation of Article 1 verse (3) and analyzed the state of Indonesia as constitutional state by its elements. This research applied the Historical Approach and Conceptual Approach. The results showed that the formulation of the Indonesia as constitutional state in Article 1 verse (3) of the constitution after amendment is just consequence of the MPR agreement to pick up the normative content in the Explanation of the Constitution before amendment becomes a part of Articles. Then on the analysis of the elements of constitutional state was found the general elements and special elements of the Indonesian constitutional state. The conception of the Indonesian constitutional state can be well understood solely based on Pancasila and the Indonesian Theory of State.
