| Abstrak (Bhs. Indonesia) | Kompetensi absolut dari Pengadilan Agama dan Pengadilan Negeri ada kesamaan dalam menerima, memeriksa dan menetapkan permohonan pengangkatan anak bagi pemohon yang beragama islam hal tersebut dapat mengakibatkan persinggungan kewenangan antara kedua lembaga peradilan tersebut. Mungkin saja terhadap permohonan tersebut, Pengadilan Negeri dan Pengadilan Agama menyatakan sama-sama berwenang untuk mengadili seperti dalam Penetapan Pengadilan Negeri Purwokerto Nomor 11/Pdt.P./2015/PN.Pwt. dan Penetapan Pengadilan Agama Purwokerto Nomor 130/Pdt.P/2014/PA.Pwt dan bisa pula kedua lembaga peradilan tersebut menyatakan tidak berwenang untuk mengadili perkara tersebut. Sehingga hal tersebut dapat menimbulkan ketidakpastian hukum dalam menangani permohonan pengangkatan anak khususnya bagi pemohon yang beragama islam. Metode pendekatan dalam penelitian ini adalah Yuridis Normatif. Hasil penelitian yang diperoleh adalah 1. Pengadilan Negeri Purwokerto tidak berwenang untuk menerima, memeriksa dan menetapkan permohonan anak bagi pemohon yang beragama islam karena tidak sesuai dengan Pedoman Teknis Administrasi dan Teknis Peradilan Perdata Umum dan Perdata Khusus Buku II Edisi 2007 yang terbitkan oleh Mahkmah Agung Tahun 2009, pada alinea 2 angka 7 (tujuh). 2. Akibat hukum pengangkatan anak baik di Pengadilan Negeri dan Pengadilan Agama dalam aspek hubungan keluarga, pengangkatan anak tidak memutuskan hubugan darah antara anak angkat dengan orang tua kandungnya. Aspek pewarisan, pengangkatan anak di Pengadilan Negeri anak angkat mendapatkan warisan dari orang tua angkatnya. Sedangkan di Pengadilan Agama anak angkat menerima bagian harta orangtua angkatnya berupa wasiat wajibah, sebanyak-banyaknya 1/3 (sepertiga) dari harta warisan orang tua anak angkatnya. |

Inggris) | Absolute competency coming from both Religion Court and Distric Court may establish a grey area of compentency between both judiciary as there are similarities in each other in the aspects of acceptance, inspect, as well as establishing the plea of adoption coming from moslem pleader. For example, when both judiciary declare that they have the competency for the petition of adoption such as in the case of Court Order of Purwokerto District Court Number. 11/Pdt.P./2015/PN.Pwt and the Court Order of Purwokerto Religion Court Number. 130/Pdt.P/2014/PA.Pwt, there is also the possibility that both judiciary declare that they don't have the competency in adjudicating the case. This can produce legal uncertainty in handling the plea of the adoption especially for moslem adopters. The approach method used in this research will be Juridicial Normative. The result of the research are (1) Purwokerto District Court doesn't have the jurisdiction over the case to accept, inspect, or to establish the petition for the moslem pleader because it is not in accordance with Administrative Technical Guidance and the Technicals of General Civil Judicial and Civil Law Book Number II 2007 Edition which published by the Supreme Court in 2009, paragraph 2 figure 7 (seven). (2) The legal consequences of adopting children in both District Court and Religious Court in the aspect of family relationship, does not omit the biological relation between the adoptee and their biological parents. For in the aspect of inheritance for the child, the District Court states that the adoptee will receive the inheritance from the adopter, while in the Religious Court states that the adoptee receive inheritance in the form of wajibah will, that gives the adoptee a maximum of 1/3 (a third) of total inheritance from the adopter. |
