Indonesia) | ABSTRAK PERLINDUNGAN HUKUM TERHADAP ANAK SEBAGAI KORBAN YANG MELAKUKAN PERSETUBUHAN DENGAN AYAH TIRI (Tinjauan Yuridis Putusan Pengadilan Nomor : 03/PID.Sus/2012/PN.PWT) Tindak pidana kesusilaan yang menimpa anak semakin meningkat. Tindak pidana kesusilaan yang menimpa anak salah satunya adalah persetubuhan. Kasus persetubuhan yang terjadi di Desa Dawuhan, Kecamatan Kedung Banteng, Kabupaten Banyumas dilakukan oleh ayah tiri terhadap anaknya. Berdasarkan latar belakang tersebut mendorong penulis untuk mengkaji lebih mendalam melalui penelitian dengan tujuan agar mengetahui bentuk perlindungan hukum yang diberikan kepada anak dalam hukum pidana dan perlindungan yang diberikan kepada anak yang melakukan persetubuhan ayah tiri dalam putusan pengadilan Nomor 03/PID.Sus/2012/PN/PWT. Metode penelitisn yang digunakan adalah yuridis normatif. Data sekunder yang terkumpul kemudian diolah, disajikan, dan dianalisa secara kua litatif dengan penyajian data teks naratif. Hasil penelitian menyatakan bahwa perlindungan anak sebagai korban dalam hukum pidana diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dan Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Kedua undang-undang tesebut melindungi anak bukan hanya anak sebagai pelaku namun juga anak sebagai korban. Perlindungan yang diberikan dalam putusan pengadilan nomor 03/PID.Sus/2012/PN/PWT berupa sanksi pidana kepada pelaku. Pelaku terbukti melakukan tindak pidana ‘dengan sengaja membujuk anak melakukan persetubuhan dengannya secara terus menerus’ yang memenuhi unsur Pasal 81 Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. |

Inggris) | ABSTRACT THE LAW PROTECTION OF CHILDREN AS THE VICTIM WHO DO THE SEXUAL INTERCOURSE WITH THE STEPFATHER (Juridical Review of Court Decision Number: 03/PID.Sus/2012/PN.PWT) Criminal act of morality that occurs to the children getting increase. Criminal act of morality that occurs to the children which one of them was such as sexual intercourse. Case of sexual intercourse that occurs in the Village of Dawuhan, Sub district of Kedung Banteng, Regency of Banyumas conducted by stepfather to his daughter. Based on that background it encourages the writer to examine deeper through the research with the purpose to find out the form of law protection that is given to the children in the criminal act and protection that are given to the children that do the sexual intercourse with stepfather in the court decision Number 03/PID.Sus/2012/PN/PWT. Method of research uses normative juridical. Secondary data that has been collected then managed, presented, and analyzed qualitatively with the data presentation of narrative text. Result of research explains that children protection as the victim in the criminal act regulated in Legislation Number 11, 2012 about the Court System of children criminal act and legislation Number 35, 2014 about the Change for Legislation Number 23, 2002 about Children Protection. Both of legislations protect the children not only children as the suspect but also as the victim. The protection that is given in the court decision number 03/PD.Sus/2012/PN/PWT as criminal act sanction to the suspect. The suspect is proven to do the criminal act ‘with awareness seduces the children to do the sexual intercourse with him continuously’ which fulfills the elements Article 81 Legislation Number 23, 2002 about the Children Protection. |
