| Abstrak (Bhs. Indonesia) | Surat cek merupakan salah satu bentuk surat berharga yang banvak digunakan oleh masyarakat sebagai alat pembayaran giral. Bagi pemegangnya atau pemakainya, surat cek itu sangat menguntungkan karena surat cek bersifat lebih praktis dan aman, akan tetapi di lain pihak juga ada kelemahannya, yakni penerbitan cek kosong oleh pihak-pihak tertentu. Pemegang surat cek itu memintakan pembayaran kepada bank, namun surat ceknya ditolak oleh bank dengan alasan dananya kosong, dalam hal ini tentu saja pemegang surat cek kosong itu merasa dirugikan karena ia memperoleh surat cek itu dengan cara yang jujur atau dengan itikad baik. Adapun tujuan penelitian ini untuk mengetahui tindakan yang dilakukan oleh bank sebagai tertarik apabila menemukan cek kosong, bentuk tanggung jawab penerbit terhadap pemegang cek kosong serta bentuk perlindungan hukum terhadap pemegang cek kosong vang bertikad baik. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan yang bersifat deskriptif analitis. Sumber data dalam penelitian ini menggunakan data sekunder dari bahan kepustakaan. Data diuraikan dalam bentuk teks naratif secara sistematis. Metode analisis data yang digunakan ialah metode normatif kualitatif Bank menemukan cek kosong, maka bank akan menolak untuk membayar kemudian menatausahakan cek kosong itu serta mengembalikan cek tersebut kepada pemegangnya, apabila cek itu ditolak oleh bank karena dananya kosong, maka penerbit yang menandatangani surat cek itu mempunyai tanggung jawab, yaitu penerbit mempunyai wajib regres dalam hal non pembayaran, sementara itu, pemegang cek kosong yang beritikad baik mendapat perlindungan hukum untuk memperoleh pembayaran atas cek kosong yang dimilikinya. Bentuk perlindungan hukum itu berupa hak regres yaitu hak menegur dan menuntut ganti rugi yang ditujukan kepada penariknya atau debitur-debitur lainnya jika tertariknya tidak mau melakukan atau menolak pembayarannya. |
| Abtrak (Bhs. Inggris) | Cheque is a form of security widely used by people as a means of demand deposit payment. For the holder or user, cheque is beneficial because it is more practical and safe; however, on the other side it also has a weakness that is the issuance of blank cheque by certain parties. The cheque holder wantsthe payment to the bank, but it is rejected by the bank as the fund is empty. In this case of course the blank cheque holder feelsaggrieved since he/she gets the cheque with an honest wayorgood faith. The purpose of this research is to find out the action taken by the bank as thedraweeif it finds a blank cheque, the form of the issuer’s responsibility toward the holder of the blank cheque, and the legal protection toward the holder of the blank cheque that has good faith. This research employed normative juridical method with law approach that was descriptive analytical. Data source in this research was the secondary data obtained from the literature. The data was described in narrative texts systematically. The data analysis method used was qualitative normative method. If a bank found a blank cheque, it would reject to pay it and then administeredthe chequeand returnedit to the holder, if the cheque wasrefused because the fund was empty, the issuer that had signed the cheque had a responsibility, that wasrecourseobligation in term of non-payment, meanwhile, the holder of blank cheque who had good faith gets a legal protection to obtain the payment of his/her blank cheque. The legal protection was in the form of right of recourse that was a right to rebuke andto demand compensation addressed to the draweror otherdebtors if thedraweedid not do or rejected the payment.
