| Judul Artikel | Pergeseran Paradigma Pengaturan Hukum Adat dalam Sistem Hukum Nasional Indonesia |
| Abstrak (Bhs. Indonesia) | Pergeseran Sistem Hukum Nasional yang terjadi karena adanya Amandemen UUD 1945 juga berdampak pada pergeseran pengaturan Hukum Adat yang ada di dalam UUD 1945 setelah Amandemen. Pergeseran Pengaturan dan Konsep Pengaturan Hukum Adat dalam kerangka Sistem Hukum Nasional dari yang sebelumnya dalam UUD 1945 sebelum Amandemen diatur dalam Pasal II Aturan Peralihan dan Pasal 18, kemudian dalam UUD 1945 setelah Amandemen diatur dalam Pasal 18 B ayat (1), Pasal 18 B ayat (2), Pasal 28 I ayat (3) dan Pasal 32 ayat (1). Pergeseran tersebut dalam perspektif kajian paradigma hukum dalam kerangka Sistem Hukum Nasional juga mengalami pergeseran paradigma hukum yang mempunyai konsekuensi logis adanya kesalahan pemahaman dan penerapan kedudukan Hukum Adat dalam Sistem Hukum Nasional. Penelitian ini bertujuan untuk mengetahui kedudukan Hukum Adat dalam Sistem Hukum Nasional dan Pergeseran Paradigma Pengaturan Hukum Adat dalam Sistem Hukum Nasional Indonesia dengan menggali pengaturan dan konsepsi pengaturan Hukum Adat yang ada di dalam UUD 1945 sebelum Amandemen dan UUD 1945 setelah Amandemen dan mengkalsifikasikannya dalam konsep pergeseran paradigma hukum. Metode pendekatan yang digunakan dalam penelitian ini adalah Pendekatan Sejarah Hukum (historical approach). Hasil penelitian menunjukkan bahwa kedudukan Hukum Adat dalam kerangkan Sistem Hukum Nasional mempunyai peranan sebagai bagian dari pembangunan Hukum Nasional. Kemudian, Pergeseran pengaturan Hukum Adat dalam Sistem Hukum Nasional dari UUD 1945 sebelum Amandemen ke UUD 1945 setelah Amandemen dalam perspektif Paradigma Hukum menunjukkan adanya pergeseran paradigma hukum dari Paradigma Hukum Historis ke Paradigma Hukum Positif. |

Inggris) | The shifting of the National Legal System which occurs because of the Amendment of 1945 also resulted in a shift that exist in arrangements of Adatrecht in 1945 after the Amendment. The Shift Arrangement and The Concepts Of Adatrecht Arrangement within the framework of the National Legal System before the previous constitution of 1945 before Amendment under Article II of the Transitional Provisions and Article 18, then in constitution of 1945 after the Amendment was regulared in Article 18 and paragraph (1), Article 18 and paragraph (2), the first paragraph of Article 28 (3) and Article 32 paragraph (1). That shifting in the perspective of the study of law paradigm within the framework of the National Legal System is also undergoing a paradigm shift laws that have a logical consequence of an error of understanding and application of the position of Adatrecht in the National Legal System. This study aims to determine the position of Adatrecht in the National Legal System and The Shifting Paradigm of Adatrecht in the Legal System of National Indonesia to explore arrangements and conceptions of Adatrecht setting that exist in the constitution of 1945 before Amendment and the constitution of 1945 after the Amendment and was classification in the concept of Law Paradigm shifting. The method that was used in this research is historical approach. The results point out that the position of Adatrecht in the framework of the National Legal System has a role as part of the construction of the National Law. Then, the shifting of Adatrecht in the National Legal System from the constitution of 1945 before the Amendment to the constitution of 1945 after the Amendment of the Law Paradigm perspective indicated that there was a shifting of law paradigm from Paradigm of Historical Law to Paradigm of Positive Law. |
