| Abstrak (Bhs. Indonesia) | Penelitian ini berjudul “Asas Delegatus Non Potest Delegare Dalam Subdelegasi Kewenangan Mengatur Terkait Dengan Pembentukan Peraturan Perundang-undangan Dalam Perspektif Undang-Undang Nomor 12 Tahun 2011”. Dalam ilmu perundang-undangan, terkait pelimpahan kewenangan mengatur dalam rangka pembentukan perundang-undangan, dapat dilakukan dengan cara delegasi kewenangan mengatur. Namun, pada prakteknya terdapat delegasi yang didelegasikan lebih lanjut, ketentuan tersebut dikenal dengan istilah subdelegasi kewenangan mengatur. Terdapat sebuah asas terkait subdelegasi kewenangan mengatur, yang dikenal dengan delegatus non potest delegare, dimana asas ini mengharuskan setiap subdelegasi ditentukan terlebih dahulu oleh Undang-Undang. Dengan perkataan lain, setiap subdelegasi harus didasarkan atas perintah tegas dari Undang-Undang. Pembentukan peraturan perundang-undangan di Indonesia, dalam prakteknya mengenal pula istilah delegasi maupun subdelegasi kewenangan mengatur, yang mana ketentuan keduanya diatur secara normatif dalam Undang-Undang Nomor 12 Tahun 2011. Jenis penelitian dalam penelitian ini adalah yuridis normatif, dengan pendekatan perundang-undangan dan pendekatan analisis. Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer dan bahan hukum sekunder. Metode penyajian bahan hukum dalam bentuk uraian yang disusun secara sistematis dalam bentuk teks naratif-deskriptif dan tabel. Hasil penelitian dan pembahasan menemukan adanya ketidaksesuaian antara praktek dengan pengaturan dalam Undang-Undang Nomor 12 Tahun 2011 terkait ketentuan subdelegasi kewenangan mengatur. Selain itu, tidak terdapat persesuaian unsur antara ketentuan subdelegasi menurut asas delegatus non potest delegare maupun subdelegasi dalam Undang-Undang Nomor 12 Tahun 2011. Inggris) | This research, entitled "Principle of Delegatus Non Potest Delegare In Sub Delegation of Authority Related to the establishment of legislation in the Perspective of Satute No. 12 of 2011". In the science of legislation, related to the delegation of authority to arrange for the creation of legislation, can be done by way of delegation of authority to regulate. However, in practice there is a delegation further delegated, such provision known as subdelegation authority to regulate. There is a principle related to sub-delegate the authority to regulate, known as delegatus non potest delegare, where this principle requires that each subdelegation determined beforehand by the Act. In other words, each subdelegation must be based on strict orders from the Act. The establishment of laws and regulations in Indonesia, in practice, the term know delegation nor subdelegation the authority to regulate, in which provisions both normatively regulated in Statute No. 12 of 2011. Type of this research is normative juridical, with the approach of legislation and analytical approach. Legal materials used in this research is the primary legal materials and secondary law. Methods of presentation of legal materials in the form of descriptions systematically arranged in the form of narrative-descriptive text and tables. Results of research and discussion find any discrepancies between the settings in practice with Statue No. 12 of 2011 related to the provision subdelegation authority to regulate. In addition, there is no correspondence between the provisions subdelegation element according to the principles of delegatus non potest delegare and subdelegation in Statute No. 12 of 2011.
