Abstrak (Bhs. Indonesia)Tanggung jawab pelaku usaha adalah tanggung jawab untuk melaksanakan kewajiban-kewajiban pelaku usaha sebagaimana tercantum dalam Undang-Undang Perlindungan Konsumen. Kewajiban pelaku usaha dilakukan untuk memenuhi hak-hak konsumen sebagaimana tersirat dalam Pasal 4 Undang-Undang Perlindungan Konsumen. Kasus sengketa konsumen terkait dengan tanggung jawab pelaku usaha yang telah diadili yaitu, kasus antara Tuan Edy dan Nona Yuliana selaku konsumen restoran menggugat Nikko Hotels International selaku pelaku usaha. Putusan Pengadilan Negeri Jakarta No. 474/Pdt.G/2011/PN.JKT.PST memutus bahwa pelaku usaha bertanggung jawab untuk membayar ganti rugi. Adapun Penelitian ini menggunakan metode penelitian yuridis normatif dimana diperoleh data melalui studi kepustakaan. Hasil penelitian ini menyatakan bahwa Putusan Pengadilan Negeri yang menyatakan mengabulkan tuntutan ganti rugi materil berdasarkan Pasal 1365 KUH Perdata, jo Pasal 1367 KUH Perdata, jo Pasal 19 Undang-Undang Perlindungan Konsumen sudah tepat sesuai dengan peraturan yang ada. Namun mengenai tanggung jawab ganti rugi immateril, nampaknya lebih memperhatikan status sosial dan ekonomi Penggugat, hal tersebut tidak sejalan dengan Pasal 1371 KUH Perdata. Sebaiknya Hakim dalam mempertimbangkan tanggung jawab pelaku usaha mengenai ganti rugi immateriil, mempertimbangkan status sosial dan ekonomi kedua belah pihak, agar tanggung jawab yang dibebankan khususnya dalam perkara ini, tidak membebani Tergugat sebagai pelaku usaha sesuai dengan Pasal 1371 KUH Perdata.

JURIDICAL ANALYSIS OF THE LEGAL RESPONSIBILITY BUSINESS CONSEQUENTIAL DECISION MAKING BEVERAGES IN COURT CENTRAL JAKARTA NUMBER: 474 / Pdt.G / 2011 / PN.JKT.PST BY LAW NUMBER 8 1999 ON CONSUMER PROTECTION

Responsibility of business operators are liable to perform the duties of the business as stated in the Consumer Protection Act. Obligation of effort was made to fulfill the rights of consumers as implied in Article 4 of the Consumer Protection Act. In some cases consumer disputes, there has been a violation by businesses associated with food poisoning restaurant and beverages consumed by consumers. Food poisoning after consuming a dish from a restaurant led to the responsibility of businesses for the losses suffered by consumers. Cases of consumer disputes related to consumer poisoning in a restaurant that has been brought to justice, namely, the case between Mr. Edy and Miss Juliana as consumers sued the restaurant Nikko Hotels International as businesses. Mr. Edy and Miss Juliana feel disadvantaged because of their negligence in the creation and presentation drinks that cause consumers to experience toxicity. Jakarta District Court No. 474 / Pdt.G / 2011 / PN.JKT.PST decide that businesses liable to pay compensation. The method used in this research is normative juridical research where the data obtained through library research. Results of this study stated that the decision of the District Court stated that the deed Tegugat been negligent in the manufacture of beverages that cause poisoning to be responsible for any losses suffered by the Plaintiff to grant compensation claims amounting Rp.75.000.000 material, - based on Article 1365 of the Civil Code , in conjunction with Article 1367 of the Civil Code, in conjunction with Article 19 of the Consumer Protection Act are appropriate in accordance with existing regulations. However, the responsibility for Rp.250.000.000 immaterial compensation, seems to pay more attention to the social and economic status of the Plaintiff, it is not in line with Article 1371 of the Civil Code. Should judge in considering the responsibility of businesses regarding immaterial compensation, considering the social and economic status of both parties, so that responsibilities are charged specifically in this case, does not burden the Defendant as business operators in accordance with Article 1371 of the Civil Code.
