| Abstrak (Bhs. Indonesia) | Permasalahan pada penelitian ini adalah bagaimanakah Pertimbangan Hakim dalam menjatuhkan Putusan dalam Perkara Nomor : 16/Pid/Sus/2014/PN KBM dan kekuatan pembuktian Keterangan Ahli dalam Tindak Pidana Kekerasan Fisik Dalam Rumah Tangga dalam Perkara Nomor : 16/PID/Sus/2014/PN KBM. Metode pendekatan yang digunakan adalah yuridis normative dengan sumber berupa data sekunder. Data disajikan dalam bentuk uraian yang disusun secara sistematis dengan analisis kualitatif. Hasil penelitian menunjukan dasar pertimbangan hukum hakim dalam menjatuhkan Putusan dalam Perkara Nomor : 16/Pid/Sus/2014/PN KBM adalah pertimbangan yuridis yaitu perbuatan terdakwa telah terbukti dan memenuhi unsur-unsur yang terdapat dalam Pasal 44 ayat (3) Undang-Undang Republik Indonesia Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga. Akibat perbuatan terdakwa yang mengakibatkan korban meninggal dunia sebagaimana keterangan ahli yang bersesuaian dengan keterangan terdakwa serta hasil Visum et Repertum Nomor : 474.3/39591/IPJ/23-10-2013 tanggal 22 Oktober 2013 yang ditandatangani oleh Dr.M. Zaenuri Syamsu Hidayat, Sp.KF, MSi.Med. Pertimbangan sosiologis dimana hakim telah mempertimbangkan hal-hal yang memberatkan dan meringankan terdakwa sesuai dengan ketentuan pasal 197 ayat (1) huruf (f) KUHAP. Kekuatan Pembuktian keterangan ahli dalam tindak pidana kekerasan fisik dalam rumah tangga dalam Perkara Nomor : 16/PID/Sus/2014/PN KBM adalah keterangan ahli yang diberikan dibawah sumpah dan disampaikan dimuka persidangan dan bersesuaian dengan keterangan terdakwa, berdasarkan pasal 186 KUHAP, maka keterangan ahli tersebut dapat dijadikan sebagai alat bukti yang sah sehingga mempunyai nilai kekuatan pembuktian yang sah. |

Inggris) | Problems in this study is how consideration of the judge in imposing Verdict in Case Number: 16 / Pid / Sus / 2014 / PN KBM and the strength of evidence Description of Experts in Crime within Physical Domestic Violence in Case Number: 16 / PID / Sus / 2014 / PN KBM. The method used is the juridical normative and sources in the form of secondary data. Data presented in the form of descriptions systematically arranged with qualitative analysis. The results showed a consideration based on imposing law judge decision in Case Number: 16/Pid/Sus/2014/PN KBM is a juridical considerations that defendant has been proven and meets the elements contained in Article 44 paragraph (3) of the Constitution of the Republic Indonesia Number 23 of 2004 which is about the Elimination of Domestic Violence. Due to the actions of the defendant which resulted in death of the victim as well as corresponding expert testimony with the testimony of the accused as well as the results of Visum et Repertum Number: 474.3 / 39 591 / PII / 23-10-2013 dated October 22, 2013, signed by Dr.M. Zaenuri Syamsu Hidayat, Sp.KF, sociological MSi.Med. Sociological considerations which the judge has to consider the aggravating and relieve the defendant in accordance with the provisions of Article 197 paragraph (1) letter (f) of the Criminal Procedure Code. Proving the strenght of expert testimony in criminal acts of physical violence in the household in Case Number: 16 / PID / Sus / 2014 / PN KBM is the expert testimony given under oath and delivered upfront trials and consistent with the testimony of the defendant, based on article 186 of the Criminal Procedure Code, the description of expert testimony can be used as legal evidence so as to have a valid proof strength values. |
