| Abstrak (Bhs. Indonesia) | ABSTRAK Jasa notaris pada era ini termasuk dalam kategori jasa hukum yang dianggap penting dalam masyarakat. Hal ini disebabkan karena dengan menggunkan jasa notaris masyarakat merasa aman dan terlindungi dalam melakukan perbuatan hukum dengan sesamanya, mengingat saat ini banyak terjadi pelanggaran hukum dalam masyarakat. Namun, seringkali ada oknum notaris ‘nakal’ yang tidak bertanggung jawab dan mementingkan keuntungan diri sendiri yang berakibat pada timbulnya kerugian konsumennya. Tujuan penelitian ini yaitu untuk mengetahui perlindungan hukum bagi konsumen jasa notaris berdasarkan Undang-Undang Perlindungan Konsumen (UUPK) dan Undang-Undang Jabatan Notaris (UUJN) beserta perubahannya. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan spesifikasi penelitian bersifat deskriptif. Sumber data penelitian ini menggunakan data sekunder dari bahan kepustakaan yang didukung dengan data primer dari hasil wawancara. Data diolah secara sistematis dengan metode analisis data secara normatif kualitatif. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap konsumen jasa notaris telah diatur dalam UUPK dan UUJN beserta perubahannya yaitu dengan cara mengatur hak dan kewajiban konsumen dan pelaku usaha (Pasal 4 dan Pasal 7 UUPK), adanya pengawasan oleh pemerintah (dalam hal ini dilakukan oleh Majelis Pengawas Notaris) untuk mengetahui kompetensi dan kapabilitas kinerja notaris untuk menghindari aksi notaris ‘nakal’ yang memicu timbulnya kerugian bagi konsumen pengguna jasanya, adanya sanksi baik dari UUPK maupun UUJN bagi notaris yang melanggar hak-hak konsumen dan kewajiban pelaku usaha, serta mengatur hal pemberian ganti rugi (Pasal 19 UUPK dan Pasal 84 serta Pasal 85 UUJN). |
| Abtrak (Bhs. Inggris) | ABSTRACT Notary public service at this era is included in the important law service category in society. It is because people feel safe and protected when they do such a law action with the others if they use notary public service since there are many law violations in society at this moment. However, there is ‘naughty’ notary public which are irresponsible and egoist that has consequences to the appearing his customer detriment over and over. The purpose of this research is to know the law protection for the notary public service customer based on the Law of the Customer Protection (UUPK) and the Law of the Notary Public Position (UUJN) as well as the alteration. This research is using normative juridical method with the legislation approach and the research specification is descriptive. This research data resource is using secondary data from the literature material which is supported by the primary data from interview. The data is processed systematically with the analysis method is qualitative normative. The research result shows that the law protection for the notary public service customer has been arranged in UUPK and UUJN as well as the alteration that is by arranging the right and duty of the customer and businessman (section 4 and section 7 UUPK), there is supervision by the government (in this case, it is done by the committee of the notary public supervisor) is to know the competence and capable of the notary public service performance. It is to avoid the ‘naughty’ notary public action which triggers the detriment for the customer. There is punishment even its from UUPK or UUJN for the notary public who violates the customer rights and businessman duty, also organize the compensation (section 19 UUPK and section 84 also section 85 UUJN).
