| Abstrak (Bhs. Indonesia) | Otonomi Khusus adalah daerah yang diberikan otonomi khusus. Otonomi Khusus adalah kewenangan khusus yang diakui dan diberikan kepada daerah untuk mengatur dan mengurus kepentingan masyarakat setempat menurut prakarsa sendiri berdasarkan aspirasi dan hak-hak dasar masyarakat Daerah. Kewenangan Daerah dengan otonomi khusus mencakup kewenangan dalam seluruh bidang pemerintahan, kecuali kewenangan bidang politik luar negeri, pertahanan keamanan, moneter dan fiskal, agama, dan peradilan serta kewenangan tertentu di bidang lain yang ditetapkan sesuai dengan peraturan perundang-undangan. Selain kewenangan tersebut, dalam rangka pelaksanaan Otonomi Khusus, daerah diberi kewenangan khusus berdasarkan undang-undang kekhususannya. Penelitian ini bertujuan untuk menganalisis kebijakan otonomi khusus Aceh dalam sistem ketatanegaraan Republik Indonesia dan menganalisis sistem penyelenggaran otonomi khusus Aceh dalam tinjauan Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh. Guna mencapai tujuan tersebut maka penelitian ini dilakukan dengan menggunakan pendekatan yuridis normatif. Data sekunder yang terkumpul kemudian diolah, disajikan, dan dianalisa secara normatif kualitatif dengan penyajian data teks naratif. Hasil penelitian menyatakan bahwa kebijakan otonomi khusus Aceh dalam sistem ketatanegaraan republik Indonesia terdapat perbedaan dalam kekhususan Aceh pada tiga dimensi. Pertama, dimensi peristilahan. Kedua, dimensi kelembagaan. Ketiga, pada dimensi keuangan. Penyelenggaraan otonomi khusus di Aceh dengan empat kewenangan khusus yang diberikan oleh Undang-Undang Otonomi khusus, yakni pengelolaan dana, lembaga khusus, peraturan khusus, dan kewenangan khusus lainnya. Sejak otonomi khusus diberikan, penyelenggaraan kewenangan khusus masih belum dioptimalkan dan dimaksimalkan oleh Aceh. |
| Abtrak (Bhs. Inggris) | Particular autonomy is a region where specific autonomy is given. Particular Autonomy is a distinctive authority approved and given to the area to organize and manage the interests of local citizen based on the aspirations and basic rights of the society. The regions authority and the particular autonomy cover the authority of the all government aspects except the authority of foreign policy, defense and security, monetary and fiscal, religion, and justice also certain authorities in other fields that are established according to the regulations. In addition to the authority, within the framework of implementing particular Autonomy, regions were given specific authority based on the specific regulations.The purpose of this study is to analyze the policy of Aceh's particular autonomy within the constitutional system of the Republic of Indonesia and analyzing the providing system of Aceh’s particular autonomy in the review of constitution No. 11 Year 2006 about the Aceh’s Government. In order to achieve these objectives, this research was conducted using a normative juridical approach. The secondary data that were collected was then processed, served, and normatively analyzed qualitatively with the presentation of narrative text data. The result of the study states that the policy of Aceh's particular autonomy within the constitutional system of the Republic of Indonesia there is a difference in the specificity of Aceh in three dimensions. First, the dimensions of terminology. Second, the institutional dimension. Third, the financial dimension. The implementation of particular autonomy in Aceh with four particular authority given by the Special Autonomy Law, the management of funds, specialized agencies, special regulations, and other special powers. Since the particular l autonomy granted, the implementation of particular authority is still not optimized and maximized by Aceh. |
