| Abstrak (Bhs. Indonesia) | Proses pengelolaan benda sitaan hasil tindak pidana korupsi yang dilakukan Kejaksaan Negeri merupakan suatu bagian dari tahap awal pemeriksaan perkara. Benda sitaan hasil tindak pidana korupsi pantas disebut sebagai aset berharga karena selain akan diajukan sebagai alat bukti di dalam persidangan, ia juga dapat dilelang eksekusi apabila nanti terdakwa terbukti bersalah.Akan tetapi di beberapa daerah,benda sitaan hasil tindak pidana korupsi ini justru seringkali rusak atau hilang ketika berada pada tahap awal pemeriksaan di Kejaksaan Negeri. Situasi yang kurang menguntungkan iniberpotensi menghambat jalannya penegakan hukum terhadap tindak pidana yang telah memperoleh predikatkejahatan luar biasa. Penelitian ini bertujuan untuk mengetahui proses pengelolaan benda sitaan hasil tindak pidana korupsi dan hambatan yang di alami dalam melakukan kegiatan pengelolaan di Kejaksaan Negeri secara umum, khususnya Kejaksaan Negeri Purwokerto. Penelitian ini menggunakan metode yuridis sosiologis dengan spesifikasi deskriptif analitis, yakni dengan menguraikan secara analitis terhadap permasalahan yang dihadapi, dengan setiap hal yang dinyatakan oleh informan baik secara tertulis maupun secara lisan. Hasil penelitian menunjukkan bahwa pengelolaan benda sitaan hasil tindak pidana korupsi di Kejaksaan Negeri Purwokerto berupa penitipan selama 1 (satu) minggu guna kepentingan pemeriksaan. Benda sitaan yang tengah dalam proses pemeriksaan, akan dirawat dan dipelihara sesuai sifat dan ukuran benda sitaan. Benda sitaan dengan sifat berbahaya dan mudah terbakar akan disimpan dalam suatu tempat yang tertutup dan yang bersifat mekanik akan dibersihkan fisiknya serta diperbaikimesinnya. Semuanya ditujukan agar tidak terjadi penyusutan secara kualitas maupun kuantitas dan agar nilai benda sitaan tidak jatuh saat memasuki tahap lelang eksekusi. Namun, hambatan yang dialami oleh Kejaksaan Negeri Purwokerto dalam melakukan kegiatan pengelolaan ini justruada pada faktor jatuhnya nilai benda sitaan karena mekanisme lelang yang harus menunggu proses peradilan selesai. |
| Abtrak (Bhs. Inggris) | The confiscated goods management process from corruption action which is done by Kejaksaan Negeri is the first step of the lawsuit case. It is deserved as the valuable things because besides it can be used as the evidence in the court, it also can be used for auction when the defendant is proven wrong. However in some districts, these corruption evidences often damaged or vanished in the beginning of investigation in Kejaksaan Negeri. This unprofitable situation potentially blocks the process of law enforcement to the extraordinary crime. This research’s aim is to find out the confiscated goods management process from corruption action and the obstacles which is faced in doing the investigation activity in Kejaksaan Negeri generally, particularly in Kejaksaan Negeri Purwokerto. It uses sociological juridiction with analitical descriptive specification, that is by describing analitically to the problem faced, related to everything explained by the informant both spoken as well as written. This research result shows that the management of the corruption’s confiscated goods in Kejaksaan Negeri Purwokerto is the store place during one week for investigation. The confiscated goods which is in the middle of investigation will be taken care and treated according to the characteristic and the size of it. The dangerous and flammable one will be save in covered place and the mechanical one will be cleaned and fixed. Everything is clear so that there will be no decreasing qualities or quantities and also it has purpose not to make these confiscated goods’s value drop in auction. But, the odd faced by Kejaksaan Negeri Purwokerto in doing this activity was in the dropping value of the confiscated goods because they must wait until the case closed in the court as the auction mechanism. |
