| Abstrak (Bhs. Indonesia) | Berdasarkan sifat alaminya negara memiliki tanggung jawab dalam memberikan perlindungan hukum kepada warga negaranya, dalam hal ini termasuk kepada korban perkosaan. Selama ini korban terlupakan dalam sistem peradilan pidana, aturan yang ada cenderung berorientasi pada pelaku. Dalam proses pemeriksaan oleh kepolisian korban hanya diposisikan sebagai alat bukti sedangkan haknya seringkali terabaikan. Korban tidak hanya menderita kerugian fisik dan psikis, bahkan harta benda sehingga sudah sepantasnya korban mendapat perlindungan hukum guna memulihkan kondisinya. Tujuan penelitian ini untuk mengetahui dan menganalisis perlindungan hukum yang diberikan kepolisian dalam proses pemeriksaan terhadap korban perkosaan dan mengetahui hambatan yang dihadapi oleh kepolisian. Penelitian ini menggunakan metode pendekatan yuridis sosiologis dan spesifikasi penelitian deskriptif. Data yang digunakan adalah data primer berupa hasil wawancara dan observasi terhadap kepolisian serta korban dan data sekunder berupa peraturan perundangan, buku literatur, dokumen resmi, serta situs internet. Metode penentuan informan menggunakan Purposive Sampling dengan Criterian Based Selection dan metode analisis data secara kualitatif. Berdasarkan hasil penelitian ditemukan bahwa perlindungan hukum yang diberikan oleh kepolisian terhadap korban perkosaan dalam proses pemeriksaan berlandaskan pada Pasal 5 (1) dan Pasal 6 UU No 31 Tahun 2014 tentang Perubahan Atas UU No 13 Tahun 2006 tentang Perlindungan Saksi dan Korban, namun terdapat sejumlah hak yang belum diberikan. Hal yang menghambat perlindungan hukum berasal dari faktor hukum dan faktor sarana dan fasilitas. Saran yang diberikan adalah dibuat aturan mengenai prosedur pemberian perlindungan hukum, diadakan pemenuhan sarana dan fasilitas bagi kepolisian, dilakukan peningkatan kualitas dan kuantitas penyidik dan perlu sosialisasi bagi masyarakat mengenai kesadaran hukum serta bagi kepolisian mengenai pentingnya perlindungan hukum bagi korban. |
| Abtrak (Bhs. Inggris) | Based on its nature the state has a responsibility to provide legal protection to its citizens, in this case, including the victim of rape. This whole time, victims tend to be forgotten in the criminal justice system, the rules tend to be oriented to the perpetrators. In the process of investigation by the police, victim only positioned as an evidence, while their rights are often neglected. Victims not only suffer physical and psychological damages, but also the lost of property so it is appropriated that the victims received appropriate legal protection in order to restore the physical and psychological condition. The purposes of this research was to determine and analyze the legal protection provided by the police in the process of investigation the victim of rape and determine the obstacles faced by the police in Polda Metro Jaya. This research formulated by using sociological juridical approach and the specifications was descriptive. The data used are primary data in the form of interviews and observations of the police also the victims of rape and secondary data in the form of legislation, literature books, official documents , also internet sites. The method of determining informants used Purposive Sampling with Criterian Based Selection and qualitative data analysis. Based on the results of the research found that the legal protection provided by the police to the victims of rape in the process of investigation is based on Article 5 (1) and Article 6 of Law No. 31 Year 2014 on the Amendment of Law No. 13 of 2006 on the Protection of Witnesses and Victims, however there are a number of victim’s right who has not been granted by the police. Things that impede legal protection comes from legal factors also the means and facilities factors. The advice given is made rules that explicitly describes the procedures for granting legal protection, the fulfillment of facilities for police, improvement the quality and quantity of investigators at Polda Metro Jaya, and socialization to the public about the awareness of law also the police awareness of the importance of legal protection for victims. |
