| Abstrak (Bhs. Indonesia) | Sejak tahun 2003 pengaturan pengisian jabatan pimpinan DPR telah mengalami perubahan sebanyak 3 (tiga) kali yaitu diatur didalam UU No 22 Tahun 2003 tentang SusDuk; UU No 27 Tahun 2009 tentang MD3; dan UU No 17 Tahun 2014 tentang MD3. Praktis perubahan antara ketiga Undang-Undang tersebut dilakukan dalam kurun waktu lima tahun. Perubahan setiap lima tahun sekali ini akan menyebabkan ketidakpastian dalam pelaksanaan dan penegakan hukum. Dalam penelitian ini akan membahas bagaimanakah pengisian jabatan pimpinan DPR berdasarkan UU No 22 Tahun 2003 tentang SusDuk, UU No 27 Tahun 2009 tentang MD3 dan UU No 17 Tahun 2014 tentang MD3. Berdasarkan hasil penelitian dapat diketahui bahwa pengaturan pengisian jabatan pimpinan DPR dalam ketiga UU tersebut terdapat persamaan dan perbedaan. Persamaan dan perbedaan dalam ketiga UU tersebut terdapat dalam hal pengaturan mengenai komposisi pimpinan DPR, mekanisme pemilihan pimpinan DPR, pimpinan sementara DPR, pemberhentian dan penggantian pimpinan DPR. Saran dalam penulisan ini adalah pada masa mendatang seharusnya perubahan pengaturan pengisian jabatan pimpinan DPR tidak dilakukan pada setiap 5 (lima) tahun sekali, perubahan dilakukan apabila memang benar-benar diperlukan karena perubahan situasi ketatanegaraan. |

Inggris) | Since 2003 the regulation of the filling of the leader position of DPR after experiences the alteration 3 (three) times that is regulated in the Ordinance No 22 of 2003 about SusDuk; Ordinance No 27 of 2009 about MD3; and Ordinance No 17 of 2014 about MD3. The alteration practically between those three ordinances are conducted in the period of give years. This alteration one times in five years will cause uncertainty in the implementation and law enforcement. In this research will discuss how is the filling of leader position of DPR based on the Ordinance No 22 of 2003 about SusDuk, Ordinance No 27 of 2009 about MD3 and Ordinance No 17 of 2014 about MD3. Based on the result of research it can be known that the regulation of the filling of leader position of DPR in those Ordinance have the similarity and differentiation. This similarity and differentiation in those Ordinances are explained in the regulation about the leader composition of DPR, mechanism of the leader selection of DPR, temporary leader of DPR, dismissal and replacement leader of DPR. Suggestion in this writing in the future is supposed to the regulation of filling of the leader position of DPR that will not being conducted in every 5 (five) years, this alteration is conducted if it is really needed because the change of constitution situation. |
