| Abstrak (Bhs. Indonesia) | UU Nomor 29 Tahun 2004 tentang Praktik Kedokteran menyatakan pengaturan praktik kedokteran bertujuan memberikan perlindungan kepada pasien, mempertahankan dan meningkatkan mutu pelayanan medis yang diberikan dokter (dokter dan dokter spesialis) serta dokter gigi (dokter gigi dan dokter gigi spesialis), memberikan kepastian hukum kepada masyarakat, dokter dan dokter gigi. Ada beberapa hal yang diatur dalam undang-undang tersebut, salah satunya Pasal 37 ayat 2 “Surat izin praktik dokter atau dokter gigi sebagaimana dimaksud pada ayat (1) hanya diberikan untuk paling banyak 3 (tiga) tempat”. Penelitian ini bertujuan untuk mengkaji: Pertama, efektivitas pembatasan izin praktik dokter atau dokter gigi berdasarkan UU No 29 tahun 2004. Kedua, penegakkan hukum terhadap pelanggaran izin praktik dokter yang melebihi tiga tempat praktik. Penelitian ini menggunakan metode yuridis sosiologis. Data hasil penelitian diperoleh dari wawancara dengan Kepala Dinas Kesehatan Kabupaten Banyumas dan Kepala Bidang Pelayanan kesehatan dan dokter yang praktik di 3 (tiga) tempat dan yang lebih dari 3 (tiga) tempat. Data hasil penelitian dianalisis menggunakan metode normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan diperoleh kesimpulan sebagai berikut: Pertama, Pembatasan izin praktik dokter atau dokter gigi berdasarkan Undang-undang Nomor 29 tahun 2004 tentang Praktik Kedokteran di Kabupaten Banyumas masih belum dapat berjalan efektif, karena belum semua dokter dan dokter gigi memenuhi ketentuan yang berlaku, sehingga tujuan pembatasan izin praktik 3 tempat belum tercapai. Kedua, penegakan hukum belum sesuai dengan tujuan pasal 37(2) UU 29/2004 tentang pembatasan izin praktik dokter, hal ini ada 2 faktor yaitu, faktor stuktur karena Kepala Dinas Kesehatan belum menjalankan fungsinya; faktor substansi karena adanya ketentuan yang memberikan wewenang kepada Kepala Dinas Kesehatan untuk memberikan surat tugas kepada dokter dan dokter gigi untuk melaksanakan praktik lebih dari 3 tempat. |

Inggris) | Law no. 29/2004 regarding Medical Practice states medical practice setting aims to provide protection to patients, maintain and improve the quality of medical services of physicians (doctors and specialists) and dentists (dentists and dental specialists), provide legal certainty to the community , doctors and dentists. There are a few things that set in the law, one of which Article 37, paragraph 2 "license practice doctor or dentist referred to in paragraph (1) is given only to the most 3 (three) places". This study aims to examine: First, the effectiveness of license restrictions doctor or dentist practice based on Law No. 29/2004. Second, the rule of law against the practice permit violations exceeding three doctors' offices. This study uses socio-juridical method. Data were obtained from interviews with the Chief Medical Officer of Banyumas and Head of health services and physicians who practice in three (3) place and that more than three (3) places. Data were analyzed using qualitative normative method. Based on the results of research and discussion can be concluded as follows : First , barring permission doctor or dentist practice based on Law No. 29 of 2004 on the Practice of Medicine in Banyumas is still not able to run effectively , because not all doctors and dentists meet the applicable provisions , so that the purpose limitation practice license has not been achieved 3rd places . Second , law enforcement is not in accordance with the purposes of section 37 ( 2 ) of Law 29/2004 on the limitation of the doctor's permission , it is there are two factors , namely , factor structure as Chief Medical Officer has not run ; factor of the substance because of the provision that authorizes the Chief Medical Officer to provide a letter of assignment to the doctor and dentist to carry out the practice more than 3 places . |
