| Abstrak (Bhs. Indonesia) | ABSTRAK Penelitian ini berjudul “Konflik Politik Antara Masyarakat Dengan Pemerintah Daerah Tentang Pengalihan Hak Milik Tanah Gunung Tugel di Kabupaten Banyumas”. Penelitian ini membahas tentang bagaimana proses terjadinya konflik dan peran pemerintah dalam menangani konflik hak milik tanah yang terjadi. Penelitian ini menggunakan metode penelitian kualitatif dan menggunakan pendekatan studi kasus. Tujuan dari penelitian ini untuk mendapatkan pemahaman mengenai konflik politik yang terjadi antara masyarakat dengan pemerintah daerah tentang pengalihan hak milik tanah Gunung Tugel di Kabupaten Banyumas. Hasil dari penelitian ini mengungkapkan bahwa proses terjadinya konflik politik antara masyarakat dengan pemerintah daerah tentang pengalihan hak milik tanah Gunung Tugel mengalami proses yang panjang. Konflik muncul saat terjadi jual beli tanah pada tahun 1974, saat itu tanah Gunung Tugel milik Jenderal Purnawirawan Seoprapto dibeli oleh mantan Bupati Banyumas Poedjadi untuk digunakan sebagai program penghijauan, akibatnya konflik menjadi semakin terbuka saat warga mendengar adanya kabar bahwa tanah yang ditinggali oleh warga yang menjadi ahli waris akan diambil alih oleh pemerintah daerah, selain itu konflik mengalami krisis dimana para warga ahli waris menuntut hak milik tanah kepada pihak Pemerintah Daerah Kabupaten Banyumas. Hal ini menimbulkan kekecewaan warga ahli waris sehingga membentuk kelompok ahli waris dengan tujuan menuntut dan memperjelas status tanah Gunung Tugel. Konflik tersebut semakin pelik terlebih pada awal Januari 2014 saat di Kabupaten Banyumas mengadakan pesta rakyat dalam pemilihan Bupati Banyumas. Terdapat dugaan bahwa pada saat itu mantan Bupati Mardjoko terlibat dalam pengalihan hak milik tanah Gunung Tugel. Dalam proses penyelesain konflik dilakukan warga ahli waris meminta kepada pihak pemerintah daerah dan Kejaksaan Negeri Purwokerto untuk segera menyelesaikan kasus tersebut. Peran pemerintah dalam menangani konflik yang pertama adalah agar tidak terjadi hal yang tidak diinginkan solusi yang dilakukan adalah warga masih diizinkan tinggal di atas tanah Gunung Tugel, namun kasus tetap berjalan dan diperiksa oleh pihak Kejaksaan Negeri, yang kedua pihak pemerintah menghimbau masyarakat khususnya ahli waris tanah Gunung Tugel agar tidak bersikap anarkis jika melakukan aksi protes mengenai tuntutan status tanah Gunung Tugel, dan yang ketiga adalah membentuk panitia kasus (Pansus) Gunung Tugel untuk membantu mengusut kasus pengalihan hak milik tanah dimana mekanisme kerja Pansus hanya bekerja di wilayah politik dan tidak merambah ke ranah hukum. Konflik muncul karena prosedur yang dilakukan tidak tepat dan merugikan warga sehingga masalah menjadi semakin pelik. Kata Kunci: Konflik Politik, Hak Milik Tanah, Peran Pemerintah |
| Abtrak (Bhs. Inggris) | ABSTRACT The title of this thesis is "Political Conflict Between People With Local Government About Transfer of Land Property Right Mount Tugel in Banyumas. This study discusses how the process of conflict and the role of government in addressing land tenure conflicts occur. This study used qualitative research methods and uses a case study approach. The purpose of this study was to gain an understanding of the political conflict between communities and local governments on land acquisition Mount Tugel in Banyumas. The results of this study revealed that the process of political conflict between communities and local governments on land acquisition Mount Tugel undergo a long process. Conflicts arise when there is a sale and purchase of land in 1974, when the land belongs to Mount Tugel Retired Jenderal Seoprapto purchased by former Regent Banyumas, Mr. Poedjadi to be used as a green program, the conflict became increasingly open when people hear the news that the land was inhabited by residents who became heir will be taken over by the local government, in addition to the conflict in crisis where the citizens heirs demanding land rights to the regional Government of Banyumas. This gives rise to the disappointment of the heir to form a group of heirs with demanding goals and clarify the status of the land of Mount Tugel. The conflict is more complicated especially in early January 2014 when in Banyumas held a party of the people in Banyumas regency elections. There is alleged that at the time of the former regent Mardjoko involved in land acquisition Mount Tugel. In the process of completion of the conflict made citizens heirs asked the local authorities and the State Attorney Purwokerto to immediately resolve the case. The role of government in dealing with the conflict of the first is to prevent unwanted things done is a solution that people are still allowed to stay on the land of Mount Tugel, but the case is still running and checked by the State Attorney, the second part of the government urged the public, especially the heirs of land Mount Tugel not to be anarchy if a protest regarding the status of the land of Mount Tugel demands, and the third is to form a committee of cases (Committee) Mount Tugel to help investigate cases of land acquisition where the working mechanism of the Special Committee to work only in the political realm and not venturing to the realm of law.
