| Abstrak (Bhs. Indonesia) | Penyebab semakin maraknya terjadi tindak pidana pencurian kendaraan bermotor diantaranya semakin marak juga tindak pidana penadahan. Tindak pidana penadahan biasa telah diatur didalam Bab XXX dari buku II KUHP yang dirumuskan dalam Pasal 480 KUHP sebagai tindak pidana pemudahan. Penelitian bertujuan untuk mengetahui unsur-unsur yang terbukti dalam tindak pidana penadahan kendaraan bermotor hasil pencurian dalam putusan nomor : 155/Pid.B/2013/PN.Pbg serta untuk mengetahui dasar pertimbangan hukum hakim dalam memutus perkara terhadap tindak pidana penadahan kendaraan bermotor. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif, dengan spesifikasi penelitian secara legal research sedangkan metode pengumpulan data menggunakan data sekunder dengan cara studi pustaka yang kemudian dianalisis dengan metode normatif kualitatif. Hasil yang diperoleh dari penelitian ini adalah bahwa unsur-unsur yang terbukti dalam tindak pidana penadahan Putusan Nomor : 155/Pid.B/2013/PN.Pbg. : Dwi Astriadi alias Dwi bin Dwi Mungil bersalah telah melakukan perbuatan tindak pidana penadahan, membeli sepeda motor tanpa surat kemudian menjualnya kembali dengan tujuan memperoleh keuntungan, bahwa barang itu diperoleh karena kejahatan. Dasar pertimbangan hukum Hakim dalam memutus perkara terhadap pelaku tindak pidana penadahan dalam perkara Putusan Nomor : 155/Pid.B/2013/PN.Pbg. adalah didasarkan pada fakta-fakta hukum, alat-alat bukti yang sah dalam Pasal 184 (1) KUHAP serta keyakinan hakim, barang bukti dan hal yang meringankan dan memberatkan terdakwa. Oleh karena terdakwa terbukti secara sah dan meyakinkan telah melakukan tindak pidana penadahan dijatuhi pidana penjara selama 10 (sepuluh) bulan. |
| Abtrak (Bhs. Inggris) | The cause of the increment of criminal act in the theft of motorcycle it results in the increment of the criminal act of stolen receive motorcycle. The criminal act of the stolen receive motorcycle has been regulated in Chapter XXX from book II KUHP that formulated in the Article 480 KUHP as the easiness of criminal act. This research aims to find out the proven elements in criminal act of the stolen receive motorcycle results in the decision number: 155/Pid.B/2013/PN.Pbg and to find out the basic law consideration of judge in punishing the case to the criminal act of the stolen receive motorcycle results. Method of approach in this research uses the normative juridical with the research specification as legal research and the method of data collection uses the secondary data by using the literature study procedures and then analyzed by using method of qualitative normative. The result that has been obtained from this research is that the proven elements in criminal act of the stolen receive motorcycle Number: 155/Pid.B/2013/PN.Pbg.: Dwi Atriadi as Dwi bin Dwi Mungil is considered guilty he has do the criminal act of the stolen receive motorcycle results, buys the motorcycle without any legal letters and then sold again with the purpose to get benefit, that this goods is obtained from the result of criminal. The basic law consideration of judge in punishing the case to the suspect of the criminal act of the stolen receive motorcycle results in the case Decision Number: 155/Pid.B.2013/PN.pBG. it is based on the fact of law, legal evident tools in the Article 184 (1) KUHAP and the conviction of judge, the evidence tools and the things that reduces and weighs of the suspect. Because of that the suspect is proven legally and conveniently has conducted the criminal act of the stolen receive motorcycle results and punished with the jail punishment for 10 (tent) months. |
