| Abstrak (Bhs. Indonesia) | ABSTRAK Isu tentang peredaran suku cadang palsu sepeda motor di pasaran semakin marak terjadi. Dikhawatirkan peredaran suku cadang palsu sepeda motor tersebut telah menyebar ke berbagai daerah di tanah air, tidak terkecuali di Kabupaten Banyumas. Walaupun belum adanya kasus atau laporan terkait peredaran suku cadang palsu sepeda motor di Kabupaten Banyumas, pengawasan mengenai penyelenggaraan konsumen harus tetap dilakukan, sebagaimana diatur dalam Pasal 30 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Untuk itu mengenai pengawasan terhadap barang dan/atau jasa, pengawasan oleh pemerintah diatur melalui Peraturan Menteri Perdagangan Nomor 20/M-DAG/PER/5/2009 tentang Ketentuan dan Tata Cara Pengawasan Barang dan/atau Jasa. Penelitian ini bertujuan untuk mengetahui pengawasan terhadap peredaran suku cadang sepeda motor dalam rangka perlindungan hukum terhadap konsumen di Kabupaten Banyumas berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan. Sumber data dalam penelitian ini menggunakan data sekunder dari bahan kepustakaan yang didukung dengan data primer dari hasil wawancara. Data berupa uraian yang disusun secara urut dan sistematis. Sedangkan metode analisis data yang digunakan adalah metode normatif kualitatif. Hasil penelitian menunjukkan bahwa pengawasan yang dilakukan oleh pemerintah terhadap peredaran suku cadang sepeda motor di Kabupaten Banyumas dilakukan oleh Dinas Perindustrian, Perdagangan, dan Koperasi Kabupaten Banyumas yang berupa pengawasan secara berkala dan pengawasan secara khusus merupakan pengawasan yang bersifat langsung, pengawasan tidak langsung, pengawasan preventif, dan pengawasan represif. | Abtrak (Bhs. Inggris) | ABSTRACT The issue about the distribution of imitation motorcycle spare-part in the market often happens. It is frightening if the distribution of the imitation motorcycle spare-part have been spread in may of regions in this country, not exceptional in Regency of Banyumas. Although there is no any cases or related report about the distribution of the imitation motorcycle spare-part in the Regency of Banyumas, the controlling about the implementation of the consumer must be conducted where it is regulated in the Article 30 Ordinance Number 8 in 1999 about the Consumer Protection. Because of that related through the Regulation of Trade Ministry Number 20/M-DAG/PER/5/2009 about the Determining and Procedure of the Controlling Way of the Goods and/or Service. This research aims to find out the controlling for the distribution of the motorcycle spare-part in order to the protection of law for the consumer in the Regency of Banyumas based on the Ordinance Number 8 in 1999 about the Protection of Consumer. This research uses the method of normative juridical research by using the regulation of Ordinance. Data source in this research uses the secondary data from the literatures material that are supported by the primary data from the result of interview. Data is in the form of explanations that have been arranged orderly and systematically. And the method of data analysis in this research uses the method of qualitative normative. The result of research shows that the controlling which is conducted by the government to the distribution of the motorcycle spare-part in the Regency of Banyumas it is conducted by Department of Industry, Trade, and Cooperative in the Regency of Banyumas which it is the controlling periodically and controlling specifically is the controlling that has the direct characteristic, indirect controlling, preventive controlling, and repressive controlling.
