| Abstrak (Bhs. Indonesia) | Negara Republik Indonesia adalah negara hukum, dimana adanya pembatasan kekuasaan yang dilakukan oleh hukum. Kekuasaan akan lembaga negara secara teori dibagi menjadi tiga kekuasaan yaitu, eksekutif, legislatif, dan yudikatif. Pengisian akan ketiga jabatan kekuasaan ini diisi oleh partai politik. Bahwasanya dalam sistem rekrutmen untuk pengisian jabatan ini yang dilakukan oleh partai politik memunculkan adanya peran elit politik dalam menentukan siapa-siapa saja yang akan dipilih untuk mengisi jabatan ini. Peran elit politik ini menimbulkan adanya sebuah dinasti politik dalam pengisian jabatan tersebut, dimana partai politik cenderung merekrut keluarga atau kerabat terdekatnya. Penelitian ini dilakukan dengan tujuan untuk mengetahui dan menganalisis seberapa berpengaruh dinasti politik dalam sistem kepartaian. Serta mengetahui bagaiman sisem rekrutmen yang dilakukan oleh Partai Demokrasi Indonesia Perjuangan dan Partai Demokrat. Untuk membahasnya maka digunakan metode penelitan dengan tipe yuridis normatif (normative law research). Hasil penelitian ini menunjukkan bahwa faktor elit politik sangat mempengaruhi dalam rekrutmen dan pencalonan pengisian jabatan kekuasaan negara hanya dari keluarga atau orang-orang terdekat elit politik itu sendiri. Undang-Undang Nomor 2 Tahun 2011 tentang Perubahan Atas Undang-Undang Nomor 2 Tahun 2008 tentang Partai Politik bahwa tidak adanya penjelasan lebih lanjut terkait dengan rekrutmen partai politik mengenai batasan-batasan hubungan keluarga. Sistem rekrutmen partai dibagi dalam 3 proses yaitu : penerimaan pendaftaran bakal calon legislatif, seleksi tahap I (seleksi berkas), dan seleksi tahap II. Bahwa secara proses rekrutmen tersebut menerapkan rekrutmen dengan prosedur terbuka dengan jalur rekrutmen kaderisasi. Tetapi pada praktiknya partai politik menggunakan jalur rekrutmen berdasarkan ikatan primodial. |
| Abtrak (Bhs. Inggris) | The Republic of Indonesia is a state law, where there is an existence of power limitation which is conducted by law. The power of state institutions is theoretically divided into three which is, executive, legislative, and judicial. Charging of these three departments is filled by political parties. The recruitment system for filling the positions which is being conducted by the political parties bring out the political elite in determining whoever which will be chosen for filling the positions. The role of this political elite bring out the political dynasty in filling the positions whereas political parties are tend to recruit their families or fellow relatives. This study was conducted with the objective of indentifying and analyzing how big the effect of this political dynasty in political system. And also to know how the recruitment system which is conducted by the Indonesian Democratic Party of Struggle (PDI-P) and Democratic Party. The type of research was normative law research The result of study shows that political elite factors is greatly affecting the recruitment system and proposing the candidate to filling the positions is only from families or fellow relatives of the political elite itself. Under constitution Number 2 year 2011 about the changing of constitution Number 2 year 2008 about Political Parties which is there is no further explanation about political party recruitment in terms of family relation restrictions. Party recruitment systems divided into three processes, which is; the registration of legislative candidates, first step selection (file selection), and second step selection. in terms of process, they implement an open procedure recruitment in way of regeneration recruitment. But in practice, political party is using a primordial recruitment system. |
