| Abstrak (Bhs. Indonesia) | Pemilihan umum kepala daerah dalam prakteknya banyak mengalami kecurangan. Hal tersebut yang menyebabkan timbulnya sengketa dari para peserta pemilihan umum kepala daerah. Sebagai contoh adalah pemilihan umum kepala daerah yang berlangsung di Kabupaten Ende, Provinsi Nusa Tenggara Timur tahun 2013. Dalam pemilihan tersebut, pemohon selaku Bupati yang sedang menjabat, mengajukan permohonan keberatan atas berita acara rekapitulasi hasil penghitungan suara pemilihan umum kepala daerah kabupaten Ende tahun 2013 putaran kedua ke Mahkamah Konstitusi, dikarenakan pasangan lain yang menjadi lawannya diduga melakukan pelanggaran yang bersifat masif, sistematis, dan terstruktur. Ketentuan Pasal 236C undang-undang nomor 12 tahun 2008 tentang perubahan kedua atas undang-undang nomor 32 tahun 2004 tentang pemerintahan daerah telah mengalihkan kewenangan memutus perselisihan hasil pemilihan umum kepala daerah dari Mahkamah Agung ke Mahkamah Konstitusi. Dengan adanya putusan Mahkamah Konstitusi Nomor 97/PUU-XI/2013, kewenangan memutus perselisihan hasil pemilukada kembali menjadi kewenangan Mahkamah Agung, namun dalam amar putusannya menyatakan bahwa Mahkamah Konstitusi masih berwenang memutus perselisihan hasil pemilukada, selama belum ada undang-undang yang mengatur mengenai hal tersebut. Setelah diundangkannya undang-undang Nomor 22 Tahun 2014 tentang pemilihan gubernur, bupati, dan walikota yang kemudian dicabut dengan peraturan pemerintah pengganti undang-undang Nomor 1 Tahun 2014 tentang pemilihan gubernur, bupati, dan walikota kewenangan menyelesaikan sengketa pemilukada masih tetap Mahkamah Konstitusi sebelum peraturan pemerintah pengganti undang-undang tersebut diundangkan menjadi undang-undang. |
| Abtrak (Bhs. Inggris) | The election of the Head of Regional in its implementation there are experiencing the deceitfulness. This causes the emergence of the disputes from the participant of election of the head of regional. For example, there is the election of the head of regional that occurs in the Regency of Ende, Province of Nusa Tenggara Timur in 2013. In this election, the requester will be objection for the recapitulation news of the counting result of election of the head of regional in the regency of Ende in 2013 in the second round to the Constitution Court, it is caused the other participant that become the opponent is suspected doing the violation in massive, systematic, and structured characteristic. The regulation in the Article 236 C Ordinance Number 12 in 2008 about the second alteration for the Ordinance Number 32 in 2004 about the regional government which they have changed the authority to decide the dispute of the result of election of the Head of Regional from the Supreme Court to Constitution Court. Related with the decision of the Constitution Court Number 97/PUU-XI/2013, the authority to decide the dispute of the result of election of the Head of Regional Election again become the authority of the Supreme Court, but in its decision explains that the Constitution Court still having authority to decide the dispute of the result of regional election, along with there does not has the ordinance that regulates about that. After the establishment of the ordinance Number 22 in 2014 about the election of governor, regency, and major that then amended with the government regulation amendment Number 1 in 2014 about the election of governor, regent, and major in the authority to accomplish the dispute of the regional election still become authority of Constitution Court before government regulation of ordinance amendment that is amended to become the Ordinance. |
