| Abstrak (Bhs. Indonesia) | Tata cara pembentukan peraturan perundang-undangan merupakan suatu tahapan kegiatan yang dilaksanakan secara berkesinambungan untuk membentuk peraturan perundang-undangan. Dasar hukum pembentukan peraturan perundang-undangan adalah UU No. 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan yang merupakan pengganti dari UU No. 10 Tahun 2004. Salah satu jenis peraturan perundang-undangan dalam hierarkhis perundang-undangan adalah Peraturan Daerah. Berdasarkan hal tersebut, maka permasalahan dalam penelitian ini adalah: bagaimanakah proses penyusunan Peraturan Daerah berdasarkan UU No. 10 Tahun 2004 dan berdasarkan UU No. 12 Tahun 2011? Metode penelitian yang digunakan adalah yuridis normatif, dengan metode pendekatan perundang-undangan (Statute Approach) dan pendekatan komparatif (Comparative Approach). Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer dan bahan hukum sekunder untuk kemudian dianalisis dengan menggunakan metode analisis normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan tentang studi komparasi penyusunan Peraturan Daerah berdasarkan UU No. 10 Tahun 2004 dan UU No. 12 Tahun 2011, maka dapat disimpulkan bahwa terdapat 3 (tiga) perbedaan dan/atau pembaharuan yang dimuat dalam UU No. 12 Tahun 2011, yaitu: (1) Pengajuan Rancangan Peraturan Daerah disertai dengan Naskah Akademik sebagaimana ditegaskan dalam Pasal 56 ayat (2) UU No. 12 Tahun 2011; (2) Setiap tahapan pembentukan peraturan perundang-undangan mengikutsertakan perancang Peraturan Perundang-undangan sebagaimana ditegaskan dalam Pasal 98 ayat (1) UU No. 12 Tahun 2011; dan (3) Tahapan pembentukan Undang-Undang, Peraturan Daerah Provinsi, dan Peraturan Daerah Kabupaten/Kota mengikutsertakan peneliti dan tenaga ahli sebagaimana ditegaskan dalam Pasal 99 UU No. 12 Tahun 2011. |
| Abtrak (Bhs. Inggris) | The procedure of the establishment of the ordinance regulation is o stage of the activity that conducted continuously to make the ordinance regulation. The foundation of law establishment of the ordinance regulation is The Law No. 12 in 2011 about the Establishment of the Ordinance Regulation that is the amendment of the The Law No. 10 in 2004. One of the type of the ordinance regulation in the ordinances hierarchy is the Regional Regulation. Based on the explanation above, so the problem in this research is how is this composing process of Regional Regulation based on The Law No. 10 in 2004 and based on The Law No. 12 in 2011? Method of Research uses the normative juridical by using method of statute approach and comparative approach. Material of law in this research uses the material of primary law and material of secondary law then analyzed by using the method of qualitative normative analysis. Based on the result of research and discussion about the comparison study of the composing of Regional Regulation that based on The Law No. 10 in 2004 and The Law No. 12 in 2011, so it can be concluded that there is 3 (three) differences and/or reformation that has been made in The Law No. 12 in 2011, that is: (1) the Proposal of the Regional Regulation Design followed with the Academic Draft as explained in the article 56 (2) The Law No. 12 in 2011; (2) Every stages of the establishment of the ordinance regulation inserts the design of the ordinance regulation as explained in the Article 98 (1) The Law No. 12 in 2011; and (3) The stages of the Ordinance establishment, Regulation of Province Region, and Regulation of Regency/City Region insert the research and experts as explained in the Article 99 The Law No. 12 in 2011. |
