Eksistensi calon independen dalam pemilihan kepala daerah adalah hal baru dalam sistem pemilihan umum RI, khususnya pemilihan kepala daerah (pilkada). Akses perorangan untuk dapat dipilih sebagai kepala daerah tanpa melalui jalur partai politik. Sebelum amandemen oleh Mahkamah Konstitusi, Undang - Undang Nomor 32 Tahun 2004 dan Peraturan Pemerintah Nomor 6 Tahun 2005 memang mengharuskan pasangan calon kepala daerah hanya bisa diusulkan oleh partai politik atau gabungan partai politik. Akan tetapi, pasca Putusan Mahkamah Konstitusi Nomor 5/PUU-V/2007 pada tanggal 23 Juli 2007 membolehkan pasangan independen untuk ikut serta dalam pilkada.
Melanjutkan putusan MK tersebut pemerintah melalui Undang – Undang Nomor 12 Tahun 2008 melakukan perubahan atas Undang - Undang Nomor 32 Tahun 2004. Dalam UU tersebut juga diatur mengenai ketentuan pengisian jabatan wakil kepala daerah yang menggantikan kepala daerah yang diberhentikan secara  tetap, pengisian jabatan wakil kepala daerah yang berhenti atau diberhentikan, dan agenda untuk mengintegrasikan penyelenggaraan Pilkada dengan Pemilihan Umum (Pemilu), sehingga pada saatnya nanti penyelenggaraan Pemilu tidak saja memilih calon anggota DPR, DPD, DPRD Provinsi, dan DPRD Kabupaten/Kota, serta Presiden dan Wakil Presiden tetapi juga memilih Kepala dan Wakil Kepala Daerah.
Pilkada yang diikuti oleh pasangan independen baru dimulai pada tahun 2008. calon yang benar-benar independen dan tidak bergantung pada organisasi keanggotannya apapun1. Meski begitu hal ini bukan tanpa masalah, realitas dalam pelaksanaan pilkada di Indonesia sampai saat ini tetap menunjukan bahwa calon independen belum bisa berbuat banyak meski tetap ada di daerah-daerah pemilihan tertentu yang dimenangkan oleh pasangan calon independen, seperti pilkada di Garut.
Pada dasarnya prosedur pengisian jabatan wakil kepala daerah yang kosong telah diatur dalam Undang -Undang Nomor 32 Tahun 2004. Namun dalam Pasal 35 ayat (2) Undang -Undang Nomor 32 Tahun 2004, prosedur tersebut dilaksanakan jika sisa masa jabatan kepala daerah dan wakil kepala daerah yang bersangkutan lebih dari 18 (delapan belas) bulan. Melihat ketentuan tersebut maka dapat diartikan bahwa jabatan wakil kepala daerah yang kosong karena diangkat menjadi kepala daerah, berhenti atau diberhentikan yang sisa masa jabatannya kurang dari atau tepat 18 bulan akan dibiarkan kosong. Dengan adanya perubahan ini, maka kekosongan jabatan wakil kepala daerah dengan prosedur yang demikian itu menjadi jelas, karena prosedur itu dijalankan apabila sisa masa jabatan yang harus dijalankan adalah 18 bulan atau lebih. Prosedur ini dapat ditemukan dalam Pasal 26 Undang – Undang Nomor 12 Tahun 2008.
Fenomena pemilukada yang melibatkan pasangan independen seperti pemilukada tahun 2009 yang terjadi di Garut dimana pasangan Aceng HM Fikri dan Dicky Chandra memenangkan pemilukada saat itu. Pasangan Bupati dan Wakil Bupati ini melaksanakan tugasnya dengan baik selama kurun waktu 2 tahun. Pada bulan September 2011, Wakil Bupati Dicky Chandra mengajukan surat pengunduran diri, Dicky mengaku tidak mampu lagi membangun sinergi dengan pimpinan daerah lainnya (bupati). Pengunduran diri Dicky Chandra telah dikabulkan Menteri Dalam Negeri (Mendagri) Gamawan Fauzi melalui Surat Keputusan (SK) Nomor 132.32-829 Tahun 2011 Serah terima SK dilakukan pada hari Senin, 5 Desember 2011 di Kantor Pemerintah Provinsi Jawa Barat Gedung Sate, Bandung. Gubernur Jawa Barat Ahmad Heryawan menyerahkan SK pengunduran kepada Dicky Chandra, di ruang rapat utama Gedung Sate.
Berdasarkan Peraturan Pemerintah No. 49 tahun 2008 tentang Pemilihan, Pengangkatan dan Pengesahan Pemberhentian Pasangan Kepala Daerah, apabila terjadi kekosongan wakil kepala daerah yang sisa masa jabatannya mencapai 18 bulan, kepala daerah atau bupati dapat mengusulkan 2 nama calon penggantinya.
Oleh karena itu, Bupati Garut mencari pengganti Dicky Chandra hingga terpilihlah dua orang bakal calon. Agus Hamdani dan Usep Zaenal, merupakan dua orang bakal calon wakil bupati yang diusulkan bupati Garut, Aceng HM Fikri kepada pihak DPRD Garut. Pada pemilihan wakil bupati Garut oleh DPRD Garut, Agus Hamdani yang diusung Partai Persatuan Pembangunan (PPP) terpilih menjadi wakil bupati setelah mengalahkan Usep sebagai calon independen melalui voting di DPRD Garut. Agus Hamdani meraih 42 suara. Sementara calon lainnya, Usep Zaenal Arifin hanya mendapatkan enam suara. Dua suara menyatakan abstain. Pada tanggal 12 Juni 2012, H. Agus Hamdani GS, S.Pdi diangkat, dilantik dan disumpah menjadi Wakil Bupati Garut oleh Gubernur Jabar Ahmad Heryawan untuk sisa masa Jabatan 2009- 2014.

The existence of an independent candidate in local elections is nothing new in the electoral system of the Republic of Indonesia, particularly local elections (elections).
