PERLINDUNGAN HUKUM MEREK TERKENAL ASING “BOM” TERHADAP PENDAFTARAN MEREK DENGAN IKTIKAD TIDAK BAIK BERDASARKAN UNDANG-UNDANG NOMOR 20 TAHUN 2016 TENTANG MEREK DAN INDIKASI GEOGRAFIS (Studi Putusan Nomor 86/PDT.SUS-HKI/MEREK/2025/PN NIAGA JKT.PST)

ABSTRAK Merek memiliki peran strategis sebagai identitas produk dan aset ekonomi bagi pelaku usaha, sehingga memerlukan pelindungan hukum yang jelas. Sistem konstitutif (first to file) yang dianut Indonesia berdasarkan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis (UU MIG) kerap disalahgunakan untuk mendaftarkan merek terkenal asing yang belum terdaftar di Indonesia dengan iktikad tidak baik, sebagaimana terjadi dalam sengketa merek kosmetik “BOM” antara BSTARLIT Co.,Ltd. dan Stanley Victorius Kurniawan. Penelitian ini bertujuan menganalisis perlindungan hukum terhadap merek terkenal asing “BOM” serta akibat hukum pembatalan merek “BOM Beauty of Majesty” dalam Putusan Nomor 86/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt.Pst. Penelitian ini menggunakan metode yuridis normatif dengan spesifikasi deskriptif analitis, sumber data sekunder, teknik studi kepustakaan, dan analisis normatif kualitatif. Hasil penelitian menunjukan bahwa merek “BOM” memenuhi kriteria merek terkenal berdasarkan Pasal 18 ayat (3) Permenkumham Nomor 67 tahun 2016 sehingga berhak atas perlindungan hukum meskipun belum terdaftar, prinsip first to file dapat dikesampingkan karena pendaftaran Tergugat terbukti memiliki persamaan pada pokoknya serta dilandasi iktikad tidak baik. Akibat hukumnya adalah hapusnya hak eksklusif Tegugat dan kewajiban DJKI mencoret merek tersebut. Disarankan agar pemilik merek asing segera mendaftarkan mereknya di Indonesia.

ABSTRACT Trademarks play a strategic role as product identity and economic assets for business actors, requiring clear legal protection. Indonesia’s first-to-file constitutive system under Law Number 20 of 2016 on Trademarks and Geographical Indications is often exploited to register unregistered foreign well-known trademarks in bad faith, as occured in the dispute over the cosmetic mark “BOM” between BSTARLIT Co.,Ltd. and Stanley Victorinus Kurniawan. This research aims to analyze legal protection for the foreign well-known trademark “BOM” and the legal consequences of canceliing the “BOM Beauty of Majesty” mark under Decision Number 86/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt.Pst/ The research employs a normative juridical approach with analytical descriptive spesification, secondary data sources, literature study techniques, and qualitative normative analysis. The findings show that the “BOM” mark meet the well-known trademark criteria under Article 18(3) of Ministerial Regulation No.67 of 2016, entitling it to legal protection despite being unregistered, and that the first-to-file principle may be overridden since the defendant’s registration was proven to have essenstial similirity and bad faith. The leg.al consequence is the loss of the defendant’s exclusive rights and on obligation for the Directorate General of Intellectual Property to remove the mark. Foreign trademark owners are advised to promptly register their marks in Indonesia.
