ANALYSIS OF JUDGES' LEGAL CONSIDERATIONS AGAINST THE PERPETRATOR CRIMINAL ACTS OF PHARMACEUTICAL PRACTICE WITHOUT MEETS SAFETY STANDARDS (Study of District Court Decision Number 397/Pid.Sus/2025/PN Cjr)

Kesehatan merupakan hak asasi manusia yang pelaksanaannya di bidang kefarmasian menuntut keahlian dan kewenangan khusus guna menjamin keselamatan konsumen. Praktik distribusi sediaan farmasi oleh pihak tanpa kompetensi hukum merupakan kejahatan yang mengancam ketahanan kesehatan publik. Penelitian ini bertujuan untuk menganalisis pertimbangan hukum hakim (ratio decidendi) serta akibat hukum terhadap pelaku tindak pidana praktik kefarmasian yang tidak memenuhi standar keamanan, difokuskan pada Putusan Nomor 397/Pid.Sus/2025/PN Cjr. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Hasil penelitian menunjukkan bahwa pertimbangan hakim telah mencerminkan penalaran yudisial yang progresif dalam menerapkan Pasal 435 UU Nomor 17 Tahun 2023 tentang Kesehatan. Hakim menafsirkan ketiadaan Surat Izin Praktik Apoteker (SIPA) dan izin edar bukan sekadar pelanggaran administratif, melainkan perbuatan melawan hukum materiil yang menggugurkan jaminan keamanan produk farmasi. Pembuktian ini juga ditopang secara mutlak oleh alat bukti ilmiah (scientific evidence) berupa uji laboratorium forensik. Akibat hukum yang ditanggung terdakwa adalah pidana penjara selama 2 tahun 3 bulan serta perampasan barang bukti obat keras. Penjatuhan sanksi tersebut dinilai berhasil mengharmonisasikan tiga pilar teori tujuan hukum Gustav Radbruch, yaitu kepastian hukum melalui penerapan sanksi yang tegas, kemanfaatan hukum untuk memutus rantai peredaran obat berbahaya di kalangan generasi muda, serta keadilan proporsional yang mengalkulasi latar belakang sosiologis dan sikap kooperatif terdakwa.

Health is a human right whose implementation in the pharmaceutical field requires specific expertise and authority to ensure consumer safety. The practice of distributing pharmaceutical preparations by parties without legal competence is a crime that threatens public health security. This study aims to analyze the judge's legal consideration (ratio decidendi) and the legal consequences for the perpetrator of a criminal act of pharmaceutical practice that does not meet safety standards, focusing on Decision Number 397/Pid.Sus/2025/PN Cjr. This research employs a normative juridical research method with a statute approach and a case approach. The results indicate that the judge's consideration reflects progressive judicial reasoning in applying Article 435 of Law Number 17 of 2023 concerning Health. The judge interprets the absence of a Pharmacist Practice License (SIPA) and distribution license not merely as an administrative violation, but as a material unlawful act that nullifies the safety guarantees of pharmaceutical products. This evidentiary process is also absolutely supported by scientific evidence in the form of forensic laboratory tests. The legal consequence borne by the defendant is imprisonment for 2 years and 3 months, as well as the confiscation of evidence in the form of hard drugs. The imposition of these sanctions is considered successful in harmonizing the three pillars of Gustav Radbruch's theory of legal objectives, namely legal certainty through the application of strict sanctions, legal utility to break the distribution chain of dangerous drugs among the younger generation, and proportional justice that takes into account the sociological background and the cooperative attitude of the defendant.
