Berkembangnya internet membentuk ruang baru untuk berekspresi dan mengakses informasi. Sebagai langkah untuk mengikuti perkembangan jaman, pemerintah telah mengeluarkan Pasal 40 dan 40A UU ITE tentang moderasi konten untuk mengatur penyebaran informasi dan berekspresi di ruang digital agar dapat melindungi hak warga negara lainnya. Penelitian ini ingin mencari tahu bagaimana pengaturan moderasi konten dalam Pasal 40 dan 40A UU ITE dari
sudut pandang HAM. Lebih lanjut, penelitian ini juga mencari tahu bagaimana implikasi yuridis pengaturan moderasi konten terhadap hak konstitusional warga negara. Penelitian ini merupakan penelitian yuridis normatif, dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian yang diperoleh menunjukkan bahwa pengaturan moderasi konten yang terdapat pada Pasal 40 dan Pasal 40A UU ITE masih belum sesuai dengan pembatasan hak asasi manusia. Adapun dilihat implikasi yuridis aturan moderasi konten menunjukkan bahwa Pasal 40 dan Pasal 40A UU ITE mendegradasi hak konstitusional kebebasan berekspresi dan mengakses informasi.

The development of the internet has created a new space for expression and access to information. As an effort to keep pace with times, the government has enacted Articles 40 and 40A of the Electronic Information on an Transactions Law (ITE Law) on content moderation to regulate the distribution of information and expression in the digital space in order to protect the rights of other citizens. This study aims to find out how the content moderation regulations in Articles 40 and 40A of the ITE Law are regulated from a human rights perspective. Furthermore, this study also seeks to find out the legal implications of content moderation regulations on citizens' constitutional rights. This study is a normative legal study, with a legislative approach and a conceptual approach. The results of the study show that the content moderation regulations contained in Articles 40 and 40A of the ITE Law are still not in accordance with human rights restrictions. The legal implications of content moderation regulations show that Articles 40 and 40A of the ITE Law degrade the constitutional rights of freedom of expression and access to information.
