DIKABULKANNYA WALI ADHAL KARENA KONFLIK KELUARGA (Studi Putusan Pengadilan Agama Pemalang Nomor 0709/Pdt.P/2023/PA.Pml)

UU Perkawinan dan KHI mengatur terkait sahnya pernikahan yaitu dengan yaitu calon suami, calon istri, wali, 2 (dua) orang saksi, ijab dan qobul. Penelitian ini terkait ditolaknya rujuk antara Pemohon dengan Calon Suami Pemohon oleh wali Pemohon yang enggan menikahkan. Rumusan masalah yang dianalisis oleh Peneliti adalah bagaimana menetapkan wali adhal karena konflik keluarga dalam pertimbangan hukum hakim dan bagaimana akibat hukum dikabulkannya wali adhal pada Penetapan Pengadilan Agama Kabupaten Pemalang Nomor 0709/Pdt.P/2023/PA.Pml. Tipe penelitian yuridis normatif menggunakan metode pendekatan perundang-undangan, kasus, dan konseptual, spesifikasi penelitian preskriptif analitis, sumber data menggunakan data sekunder, metode pengumpulan data studi kepustakaan dan metode analisis menggunakan normatif kualitatif. Hasil penelitian yaitu majelis hakim berwenang mengadili perkara berdasar Undang-Undang No. 7 Tahun 1989 Tentang Peradilan Agama. Permohonan wali adhal dikabulkan dalam penetapan oleh Majelis hakim berdasar Pasal 5 ayat (2) dan (3) Permenag 30/2005 tentang Wali Hakim dan Hadits Nabi SAW karena memenuhi 3 (tiga) syarat yaitu Pemohon telah dipinang Calon Suami Pemohon, adanya penolakan dari wali Pemohon, dan wali Pemohon telah dipanggil oleh Pengadilan Agama. Pernikahan yang menjadi rujuk antara Pemohon dan Calon Suami Pemohon adalah alasan Wali Pemohon melakukan penolakan. Akibat dikabulkannya permohonan penetapan wali adhal maka berpindahnya perwalian dari wali nasab Pemohon ke wali hakim dan pernikahan yang menggunakan wali hakim dianggap sah baik menurut agama maupun negara. Menurut Peneliti, penambahan Pasal 23 KHI tentang wali nikah dapat dilakukan oleh wali hakim ditambahkan ke dalam pertimbangan hukum hakim jika wali nasabnya adhal dan mendapatkan penetapan pengadilan agama.

The Marriage Law and KHI regulate the validity of marriage, namely the prospective husband, prospective wife, guardian, 2 (two) witnesses, ijab and qobul. This research is related to the refusal of reconciliation between the Applicant and the Applicant's prospective husband by the Applicant's guardian who is reluctant to marry. The formulation of the problem analyzed by the researcher is how to determine the guardian adhal due to family conflict in the legal consideration of the judge and how the legal consequences of the granting of guardian adhal in the Stipulation of the Pemalang Regency Religious Court Number 0709/Pdt.P/2023/PA.Pml. Normative juridical research type using statutory, case, and conceptual approach methods, analytical prescriptive research specifications, data sources using secondary data, literature study data collection methods and analysis methods using qualitative normative. The result of the research is that the panel of judges is authorized to hear cases based on Law No. 7 of 1989 concerning Religious Courts. The application for wali adhal was granted in the determination by the panel of judges based on Article 5 paragraphs (2) and (3) of Permenag 30/2005 concerning Wali Hakim and the Prophet's Hadith because it fulfills 3 (three) conditions, namely the Applicant has been proposed to by the Applicant's prospective husband, there is a refusal from the Applicant's guardian, and the Applicant's guardian has been summoned by the Religious Court. The marriage that became a reconciliation between the Applicant and the Applicant's Prospective Husband was the reason the Applicant's guardian refused. As a result of the granting of the application for the determination of guardian adhal, the guardianship of the applicant's nasab guardian moves to the judge's guardian and the marriage using the judge's guardian is considered valid both according to religion and the state. According to the researcher, the addition of Article 23 of the Compilation of Islamic Law that the marriage guardian can be carried out by the judge's guardian is added to the judge's legal consideration if the nasab guardian is adhal and gets a religious court determination.
