Penerapan Asas Praduga Tak Bersalah Terhadap Tersangka Tindak Pidana di Kepolisian Polresta Sidoarjo

Asas praduga tak bersalah telah diatur dalam undang-undang, namun dalam prakteknya di lapangan masih dijumpai oknum polisi yang kurang menghormati pelaksanaan asas praduga tak bersalah, dimana dalam penyidikan polisi menggunakan kekerasan fisik ataupun memaksa tersangka untuk mengakui tindakannya secara terpaksa karena takut akibat tekanan dari pihak penyidik. Pendekatan masalah yang digunakan untuk penelitian ini adalah Pendekatan secara yuridis empiris yaitu pendekatan yang dilakukan dengan mempelajari kejadian apa yang sebenarnya terjadi di lapangan yang bertujuan mendapatkan informasi maupun data yang bisa dipercaya kevalidannya. Adapun hasil penelitian ini adalah penerapan asas praduga tak bersalah dalam proses penyidikan di Polresta Sidoarjo belum sepenuhnya optimal karena masih dijumpai praktik dari penyidik yang tidak menerapkan asas praduga tak bersalah dan cenderung menggunakan kekerasan terhadap tersangka serta Faktor-faktor penghambat pelaksanaan asas praduga tak bersalah di lingkungan Kepolisian Polersta Sidoarjo antara lain adalah kurangnya profesionalitas dan keahlian polisi dapat menghambat penerapan asas praduga tak bersalah. Selain itu, kurangnya pengetahuan masyarakat dan kurangnya system pengawasan dalam proses penyidikan.

The principle of presumption of innocence has been regulated in law, but in practice in the field there are still police officers who do not respect the implementation of the principle of presumption of innocence, where in the police investigation they use physical violence or force the suspect to confess his actions by force because he is afraid due to pressure from the investigator. The problem approach used for this research is an empirical juridical approach, namely an approach that is carried out by studying what actually happens in the field which aims to obtain information and data that can be trusted for validity. The results of this study are the application of the presumption of innocence in the investigation process at Sidoarjo Police Station is not fully optimal because there are still practices from investigators who do not apply the presumption of innocence and tend to use violence against suspects and factors inhibiting the implementation of the presumption of innocence in the Sidoarjo Police Department, among others, the lack of professionalism and police expertise can hinder the application of the presumption of innocence. In addition, the lack of public knowledge and the lack of a supervisory system in the investigation process.
