Pendaftaran atas merek merupakan suatu keharusan bagi pemilik merek. Indonesia menganut sistem pendaftaran konstitutif dan prinsip first to file. Prinsip first to file menegaskan bahwa yang berhak atas hak merek adalah orang yang pertama kali mendaftarkan mereknya. Merek yang sudah terdaftar dalam Daftar Umum Merek masih dapat dimintakan penghapusan pendaftaran merek. Penghapusan pendaftaran merek dapat diajukan oleh pihak ketiga yang berkepentingan ke Pengadilan Niaga. Tujuan penelitian adalah untuk mengetahui bagaimana penolakan penghapusan Merek TRICO dan akibat hukumnya berdasarkan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dalam Putusan Nomor 120/Pdt.Sus-Merek/2022/PN Niaga.Jkt.Pst. 
Metode pendekatan yang digunakan adalah metode yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan adalah data sekunder yang dikumpulkan dengan studi kepustakaan, kemudian dianalisis menggunakan metode normatif kualitatif dan disajikan dalam bentuk teks naratif.
Berdasarkan hasil penelitian dan pembahasan menunjukkan bahwa Majelis Hakim menyatakan bahwa Penggugat sebagai pihak ketiga yang berkepentingan untuk mengajukan gugatan penghapusan merek. Majelis Hakim menolak permohonan penghapusan Merek TRICO milik Tergugat karena Penggugat tidak dapat membuktikan bahwa merek milik Tergugat tidak digunakan dalam perdagangan selama 3 (tiga) tahun berturut-turut dalam Putusan Nomor 120/Pdt.Sus-Merek/2022/PN sesuai dengan ketentuan yang diatur dalam Pasal 74 ayat (1) Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Akibat hukum yang timbul dari penolakan penghapusan Merek TRICO maka Merek TRICO tidak dicoret dari Daftar Umum Merek, Sertifikat Merek milik Tergugat masih berlaku dan masih memperoleh perlindungan hukum.

Registration of a trademark is a must for the trademark owner. Indonesia adheres to the constitutive registration system and the first to file principle. The first to file principle asserts that the right to the trademark is the person who first registered the trademark. Trademarks that have been registered in the General Register of Trademarks can still be requested for the removal of trademark registration. Abolition of trademark registration can be filed by an interested third party to the Commercial Court. The purpose of the research is to find out how the refusal to delete the TRICO Trademark and its legal consequences based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications in Decision Number 120/Pdt.Sus-Merek/2022/PN Niaga.Jkt.Pst. 
The approach method used is the normative juridical method with descriptive analytical research specifications. The data source used is secondary data collected by literature study, then analyzed using qualitative normative methods and presented in the form of narrative text.
Based on the results of research and discussion shows that the Panel of Judges stated that the Plaintiff as an interested third party to file a trademark removal lawsuit. However, the Panel of Judges rejected the application for the removal of the Defendant's TRICO Trademark because the Plaintiff could not prove that the Defendant's trademark was not used in trade for 3 (three) consecutive years in Decision Number 120/Pdt.Sus-Merek/2022/PN in accordance with the provisions stipulated in Article 74 paragraph (1) of Law Number 20 Year 2016 on Trademarks and Geographical Indications. The legal consequences arising from the refusal to delete the TRICO Trademark, the TRICO Trademark is not removed from the General Register of Trademarks, the Trademark Certificate owned by the Defendant is still valid and still obtains legal protection.
