Abstrak (Bhs. Indonesia)

Seiring dengan perkembangan zaman, sebuah karya atau temuan banyak
dihasilkan oleh manusia, sehingga diperlukan perlindungan terhadap pencipta karya
atas keaslian dari ciptaan karyanya. Perlindungan terhadap Hak Cipta di Indonesia
telah diatur dalam UU Nomor 28 tahun 2014 tentang Hak Cipta. Permasalahan
tentang hak kekayaan intelektual banyak terjadi, salah satunya mengenai
perlindungan hukum terhadap pemegang Hak Cipta atas sistem tabungan emas
(GOLDGRAM).
Penelitian ini menggunakan metode pendekatan yuridis normatif dengan
spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan adalah data
sekunder ysng terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan
hukum tersier. Data yang diperoleh disajikan dengan teks naratif sistematis dan
metode analisis data yang digunakan adalah metode normatif kualitatif.
Berdasarkan hasil penelitian, Putusan Pengadilan Niaga Nomor 25/Pdt.SusHak.Cipta/2022 tidak memberikan perlindungan hukum bagi Pencipta atas karya
tulis ciptaan yang berjudul Goldgram. Gugatan Penggugat tidak dapat diterima
karena Objek yang disengketakan tidak sesuai dan tidak dilindungi berdasarkan UU
Nomor 28 Tahun 2014 tentang Hak Cipta, sehingga tidak ada akibat hukum bagi
PT Antam sebagai pihak yang melakukan penggandaan sistem investasi emas
tanpa izin Pencipta.

Along with the times, a lot of works or findings are produced by humans, so
it is necessary to protect the creator of the work for the authenticity of his work.
Protection of Copyright in Indonesia has been regulated in Law Number 28 of 2014
concerning Copyright. There are many problems regarding intellectual property
rights, one of which is the legal protection of copyright holders of the gold savings
system (GOLDGRAM).
This research uses a normative juridical approach method with analytical
descriptive research specifications The data sources used are secondary data with
primary legal materials, secondary legal materials, and tertiary legal materials.
The data obtained are presented with systematic narrative texts and the data
analysis method used is a qualitative normative method.
Based on the results of the research, the Commercial Court Decision Number
25/Pdt.Sus-Hak.Cipta/2022 does not provide legal protection for the creator of the
work entitled Goldgram. The plaintiff's lawsuit cannot be accepted because the
disputed object is not suitable and is not protected under Law Number 28 of 2014
about Copyright, so that there are no legal consequences for PT Antam as a party
who duplicates the gold investment system without the author's permission.
