Tindak pidana penganiayaan adalah perilaku sewenang-wenang dalam rangka menyakiti atau menindas seseorang yang mengakibatkan rasa sakit atau luka pada anggota badan orang lain. Hal ini terjadi di Polresta Banyumas berdasarkan data dari bulan Januari tahun 2022 hingga bulan Mei tahun 2023 terdapat 4 (empat) perkara tindak pidana penganiayaan yang berhasil dilakukan dengan penyelesaian Restorative Justice salah satunya yang menjadi bahan penelitian peneliti dengan Nomor Berkas Perkara: BP/06-83/VII/2022/Reskrim. Dalam perkara tersebut telah terjadi tindak pidana penganiayaan dengan korban GSD dan tersangka RHS yang terbukti secara sah telah melakukan suatu tindak pidana penganiayaan dengan penyelesaian berdasarkan Restorative Justice. Tujuan dilakukannya penelitian ini adalah untuk mengetahui proses dan hambatan yang dihadapi dalam penyelesaian Restorative Justice terhadap perkara tindak pidana penganiayaan pada tahap penyidikan di Polresta Banyumas. Penelitian ini menggunakan pendekatan yuridis sosiologis dengan spesifikasi penelitian deskriptif analitis. Jenis dan sumber bahan hukum dalam penelitian ini berasal dari data primer dan data sekunder. Data yang diperoleh dianalisis dengan menggunakan metode analisis kualitatif. Hasil penelitian menunjukkan bahwa proses penyelesaian perkara tindak pidana penganiayaan melalui Restorative Justice pada tahap penyidikan di Polresta Banyumas sudah sesuai dengan ketentuan Peraturan Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berdasarkan Restorative Justice. Hambatan yang dihadapi penyidik Polresta Banyumas dalam menyelesaikan perkara tindak pidana penganiayaan melalui Restorative Justice pada tahap penyidikan terdapat dalam faktor fasilitas, faktor masyarakat dan faktor kebudayaan.

The crime of abuse is arbitrary behavior in order to harm or oppress someone who causes pain or injury to the limbs of another person. This happened at Banyumas City Police Resort based on data from January 2022 to May 2023, there were 4 (four) cases of criminal abuse that were successfully resolved with Restorative Justice, one of which became the research material for researchers with Case File Number: BP/06-83/VII/2022/Reskrim. In this case there was a criminal offense of abuse with the victim GSD and the suspect RHS who was legally proven to have committed a criminal offense of abuse with a settlement based on Restorative Justice. The purpose of this research is to find out the process and obstacles faced in the settlement of Restorative Justice against criminal abuse cases at the investigation stage at Banyumas City Resort Police. This research uses a juridical sociological approach with descriptive analytical research specifications. The types and sources of legal materials in this research come from primary data and secondary data. The data obtained was analyzed using a qualitative analysis method. The results showed that the process of resolving abuse cases through Restorative Justice at the investigation stage at the Banyumas City Resort Police was in accordance with the provisions of the Regulation of the Indonesian National Police Number 8 of 2021 concerning Handling Crimes Based on Restorative Justice. The obstacles faced by Banyumas City Resort Police Investigators in resolving abuse cases through Restorative Justice at the investigation stage are facility factors, social factors and cultural factors.
