PROTECTION OF MARINE ENVIRONMENT THROUGH PARTICULARLY SENSITIVE SEA AREAS ACCORDING TO INTERNATIONAL LAW (Urgency on the Submission of the Lombok Strait as Particularly Sensitive Sea Areas)

Lingkungan laut merupakan suatu ekosistem yang terdiri dari biota laut, serta mahluk hidup dan benda mati yang ada di sekitar laut. Selat Lombok sebagai bagian dari Alur Laut Kepulauan Indonesia (ALKI) II merupakan pusat aktivitas pelayaran kapal perdagangan internasional. Perkembangan perdagangan internasional yang semakin pesat berpotensi meningkatkan risiko terjadinya pencemaran lingkungan laut di Selat Lombok. Penelitian ini bertujuan untuk mengetahui pengaturan perlindungan lingkungan laut melalui Particularly Sensitive Sea Areas (PSSA) dan menganalisa urgensi penerapan PSSA di Selat Lombok. Penelitian ini merupakan penelitian normatif dengan pendekatan perundang-undangan dan pendekatan analitis. Data yang digunakan adalah data sekunder dengan metode pengumpulan data berdasarkan studi kepustakaan serta disajikan dengan dalam bentuk uraian naratif deskriptif serta dengan metode analisis normatif kualitatif. Hasil penelitian dan pembahasan menunjukkan bahwa pengaturan secara umum hukum internasional dapat ditemukan dalam Bab XII United Nations Convention on the Law of the Sea (UNCLOS) 1982. Pengaturan perlindungan lingkungan laut secara khusus dapat ditemukan dalam Pasal 4, 5, 7, dan 8 International Maritime Organization Resolution A.982 (24) Revised Guidelines for the Identification and Designation of Particularly Sensitive Sea Areas 2005 dan Pasal 3 Bergen Ministerial Declaration on Sustainable Development 1990. Indonesia telah berupaya memberikan perlindungan lingkungan laut Selat Lombok dengan mengesahkan Keputusan Menteri Perhubungan Republik Indonesia Nomor 129 Tahun 2020 Tentang Penetapan Sistem Rute di Selat Lombok. Perlindungan lingkungan laut di Selat Lombok dibutuhkan dalam rangka menjaga ekologi, ekonomi, dan pariwisata Selat Lombok.

The marine environment is an ecosystem which consist of marine life with living creatures and inanimate objects surrounding the sea. Lombok Strait is a part of the Archipelagic Sea Lanes (ASL) II is the centre of international trade shipping. The rising intensity of international trade effecting pollution towards the marine environment in the Lombok Strait. This study aims to understand the regulation on marine environment protection through Particularly Sensitive Sea Areas (PSSA) and analyse the urgency on implementing PSSA in the Lombok Strait. This is normative legal research with statute approach and analytical approach. The data that is used in this research is secondary data with literature studies as a data collection method and is presented in a narrative descriptive form, along with a normative qualitative for the analytical method. The result of this research and discussion will show the general regulation as according to international law which is found under Part XII United Nations Convention on the Law of the Sea (UNCLOS) 1982. Specific regulation on the protection of marine environment can be found in article 4, 5, 7, and 8 International Maritime Organization Resolution A.982 (24) Revised Guidelines for the Identification and Designation of Particularly Sensitive Sea Areas 2005 and article 3 Bergen Ministerial Declaration on Sustainable Development 1990. Indonesia has been trying to give protection of the marine environment in the Lombok Strait with the passing of the Republic of Indonesia Minister of Transportation Decision Number 129 Year 2020 About the Establishment of Routing System in the Lombok Strait. The protection of marine environment in the Lombok Strait is needed for the framework of protection towards the ecology, economy, and tourism of the Lombok Strait.
