Tinjauan Yuridis Eksistensi Marine Traffic Separation Scheme di Indonesia (Studi terhadap Keselamatan dan Keamanan Pelayaran Internasional di Alur Laut Kepulauan Indonesia)

Kondisi selat pada alur laut yang dilalui oleh kapal asing terdapat bahaya-bahaya laut yang dapat menimbulkan kecelakaan kapal. Indonesia menetapkan marine traffic separation scheme (TSS) di selat dalam Alur Laut Kepulauan Indonesia (ALKI) dengan tujuan untuk keselamatan dan keamanan pelayaran internasional. Penelitian ini bertujuan untuk mengetahui pengaturan tentang Marine TSS dan menganalisis konsekuensi yuridis penetapan Marine TSS di Indonesia terhadap keselamatan dan keamanan pelayaran internasional pada ALKI. Metode penelitian yang digunakan adalah yuridis normatif dengan spesifikasi penelitian deskriptif analitis, pengumpulan data melalui studi kepustakaan, metode analisis normatif kualitatif, dan disajikan dalam teks naratif. Hasil penelitian menunjukkan bahwa Pengaturan Marine TSS di ALKI diatur dalam International Regulations for Preventing Collision at Sea/COLREGs 1972 Rule 10, International Convention for the Safety of Life At Sea (SOLAS) 1974 Chapter V Regulation 10; United Nations Convention on the Law of the Sea 1982 Article 53 Paragraph 6 - 12; Resolusi IMO A.858 (20), 27 November 1997. Peraturan perundang-undangan nasional Indonesia mengatur penetapan Marine TSS pada Pasal 14, Pasal 19 dan Pasal 21 Undang-Undang No. 6 Tahun 1996 tentang Perairan Indonesia ; Sistem Rute pada Pasal 190 Undang-Undang No. 17 Tahun 2008 tentang Pelayaran. Konsekuensi yuridis ditetapkannya Marine TSS di Indonesia tersebut, Pemerintah Indonesia memiliki kekuasaan membuat aturan terkait implementasi aturan internasional yang mengatur Marine TSS; kekuasaan menegakkan hukum dan menjalankan fungsi pengawasan dalam aktivitas lalu lintas pelayaran di Marine TSS serta kewajiban melaksanakan publikasi aturan nasional, peta-peta laut dan pedoman berlalu lintas lintas yang berlaku di Marine TSS. Kapal asing dapat melakukan lintas pada ALKI I dan II melalui TSS Selat Sunda dan Selat Lombok.

The condition of straits in sea lanes that are traversed by foreign ships has sea hazards that can cause ship accidents. Indonesia has established a marine traffic separation scheme (TSS) in the straits of the Indonesian Archipelagic Sea Lanes (IASL) with the aim for international shipping safety and security. This study aims to determine the arrangements regarding the marine TSS and to analyze the juridical consequences of establishing marine TSS in Indonesia for the safety and security of international shipping at IASL. The research method used is normative juridical with descriptive analytical research specifications, data collection through library research, qualitative normative analysis methods and presented in narrative text. The results of the study show that marine TSS arrangements at IASL are regulated in the International Regulations for Preventing Collision at Sea/COLREGs 1972 Rule 10, International Convention for the Safety of Life At Sea (SOLAS) 1974 Chapter V Regulation 10; United Nations Convention on the Law of the Sea 1982 Article 53 Paragraph 6 - 12; IMO Resolution A.858 (20), 27 November 1997. Indonesian national legislation regulates the determination of marine TSS in Article 14, Article 19 and Article 21 of Law no. 6 of 1996 concerning Indonesian Waters; The Route System in Article 190 of Law No. 17 of 2008 concerning Shipping. The juridical consequence of establishing marine TSS in Indonesia is that the Government of Indonesia has the power to make rules related to the implementation of international rules governing marine TSS; the power to enforce the law and carry out supervisory functions in shipping traffic activities in the marine TSS as well as the obligation to carry out the publication of national regulations, marine charts and traffic guidelines that apply in the marine TSS. Foreign ships can across IASL I and II through the Sunda Strait and Lombok Strait TSS.
