PUTUSNYA PERKAWINAN KARENA CERAI TALAK
(Tinjauan Yuridis Terhadap Putusan Pengadilan Agama Purwokerto 
Nomor: 1577/ Pdt.G/2009/PA.Pwt)

Perceraian dapat terjadi karena talak. Talak adalah ikrar suami dihadapan sidang Pengadilan Agama yang menjadi salah satu sebab putusnya perkawinan. Cerai talak diajukan oleh pihak suami yang petitumnya memohon untuk diizinkan menjatuhkan talak terhadap istrinya. Berdasarkan hal tersebut, penelitian ini mengkaji tentang pertimbangan hukum hakim dalam memutuskan perkara cerai talak di Pengadilan Agama Purwokerto No.1577/Pdt.G/2009/PA.Pwt dan hak bekas istri atas uang nafkah iddah, nafkah anak, dan mut’ah.
Adapun metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif dan sumber data yang digunkan adalah data sekunder. Seluruh data yang telah terkumpul secara lengkap dari hasil penelitian kemudian dianalisis dengan menggunakan metode analisis normatif kualitatif.
Berdasarkan hasil penelitian dan pembahasan, maka dapat diambil kesimpulan bahwa pertimbangan hukum hakim dalam memutuskan perkara cerai talak di Pengadilan Agama Purwokerto dalam Putusan No. 1577/Pdt.G/2009/PA/Pwt adalah rumah tangga Pemohon dengan Termohon sudah tidak harmonis, Pemohon dengan Termohon berpisah tempat tinggal dan telah berlangsung selama 5 tahun, selama berpisah tersebut sudah tidak ada hubungan lagi baik lahi maupun bati, dan keluarga Pemohon dan Termohon maupun hakim telah berusaha untuk melakukan ishlah (upaya perdamaian) tetapi tidak membuahkan hasil. Berdasarkan Putusan No. 1577/Pdt.G/2009/PA.Pwt., diketahui pula bahwa bekas istri berhak atas uang nafkah iddah selama 3 bulan sebesar Rp 1.350.000,- (satu juta tiga ratus lima puluh ribu rupiah), nafkah 3 orang anak tiap bulan minimal sebesar Rp 900.000,- (Sembilan ratus ribu rupiah), dan mut’ah berupa uang sebesar Rp 1.000.000,- (satu juta rupiah).

The Break Down of Marriage due to “Talaq” Divorce
(Judicial Review on The Decision of Purwokerto Religion Court,

A divorce can happen due to “talaq” (sayings on words spoken by husbands). “Talaq” is spoken words or statements at the religions court, and one of causes og divorces. The “talaq” divorce it proposed by husbands whose “petitum” isrequestion of permission to drop a “talaq on his wife. On the basic on that matter, this study was aimed to review the degree of judges in considering the problem of “talaq” divorces at the Purwokerto Religions Court Number 1577/Pdt.G/2009/PA.Pwt and the sights of former unives for the iddah money, child costs, an mut’ah.
The approach method used in this study was normative, juridical approach, the specification of which was descriptive, by using secondary data. The collected data then worse analysed by using a qualitative, normative analysis method.
Based on the results of this study and the discussion, it can be concluded that the considerationof the judges in putting the dictum of the problem of “Talaq” divorces at the Purwokerto Religion Court of justice in the decision Number 1577/Pdt.G/2009/PA.Pwt, are that the relations between husband and wife are disharmonic, the husband and wife live at different locations for 5 years, during which time there is no biological an psychological relationship, and the families of husband and wife at the judges have conducted some effort to in agree the husband and wife peacefully (ishlah) without any successful result. On the basic of the decision number 1577/Pdt.G/2009/PA.Pwt it was also known that the former wifes had the rights for the iddah money as long as 3 months, for as much as Rp 1.350.000 (one million thirted hundred and fifty thousand rupiahs), the living cost of 3 children as much as Rp 900.000 (nine hundred thousand rupiah) each month, and mut’ah in the form of money as much as Rp 1.000.000 (one million rupiahs).
