HUBUNGAN SEMENDA SEBAGAI ALASAN PEMBATALAN PERKAWINAN
(TINJAUAN YURIDIS PUTUSAN PENGADILAN AGAMA BOYOLALI NOMOR 1114/Pdt.G/2018/PA.Bi.)

ABSTRAK

Hubungan semenda adalah suatu pertalian keluarga yang di akibatkan karena perkawinan, ialah seorang diantara suami istri dan para keluarga sedarah dari yang lain. Hubungan semenda menjadi larangan dalam pelaksanaan perkawinan, hal ini terdapat dalam Pasal 8 Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan jo Pasal 39 Kompilasi Hukum Islam, tetapi berbeda dalam Putusan Nomor 1114/Pdt.G/2018/PA.Bi yaitu terjadi perkawinan antara anak dengan ayah tirinya yang akhirnya mengajukan pembatalan perkawinan ke Pengadilan Agama Boyolali.

Rumusan masalah dalam penelitian ini adalah bagaimana dasar pertimbangan hukum hakim dalam mengabulkan pembatalan perkawinan pada putusan Pengadilan Agama Boyolali Nomor 1114/Pdt.G/2019/PA.Bi. Metode penelitian yang digunakan adalah yuridis normatif dengan spesifikasi penelitian preskriptif. Data yang digunakan dalam penelitian ini adalah data sekunder  berupa bahan-bahan hukum primer, sekunder, dan tersier. Metode pengumpulan data dilakukan dengan studi kepustakaan. Data yang diperoleh disajikan dengan teks naratif dan dianalisis dengan metode normatif kualitatif.

Berdasarkan hasil penelitian dan analisis data dapat disimpulkan bahwa pernikahan Penggugat dengan Tergugat terbukti tidak memenuhi syarat pernikahan dan bertentangan dengan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan Pasal 8 jo Pasal 39 Kompilasi Hukum Islam yakni karena adanya halangan nikah pada diri Penggugat yang ternyata Penggugat adalah anak tiri dari Tergugat sehingga dengan demikian Penggugat termasuk kelompok perempuan yang haram dinikahi selama-lamanya oleh Tergugat.

ABSTRACT

Semenda relationship is a family relationship that results from marriage, namely one between husband and wife and the blood relatives of the other. Semenda relationship is a prohibition in the implementation of marriage, this is contained in Article 8 of Law Number 1 of 1974 about Marriage in conjunction with Article 39 of the Compilation of Islamic Law, but it is different in Decision Number 1114/Pdt.G/2018/PA.Bi, namely marriage between children with his stepfather and finally proposed cancellation of marriage to the Boyolali Religious Court.

The formulation of the problem in this study is how the legal considerations of the judge in granting the annulment of marriage in the decision of the Boyolali Religious Court Number 1114/Pdt.G/2019/PA.Bi. The research method used is normative juridical, with prescriptive research specifications. The data used in this study is secondary data in the form of primary, secondary, and tertiary legal materials. The method of data collection is done by library research. The data obtained are presented with narrative texts and analyzed by normative qualitative methods.

Based on the results of research and data analysis, it can be said that the Plaintiff's marriage with the Defendant was proven not to meet the marriage requirements and contradicts with Law Number 1 of 1974 concerning Marriage Article 8 in conjunction with Article 39 of the Islamic law compilation, namely because of the marriage barrier on the Plaintiff who demanded the Plaintiff to be a stepdaughter from the Defendant so that the Plaintiff is a group of women who are forbidden to be married forever by the Defendant.
