Eksepsi gugatan kabur (Obscuur Libel) yang diajukan oleh Tergugat dapat disebabkan karena tidak terpenuhinya syarat formil dalam gugatan. Berdasarkan adanya pengajuan eksepsi tersebut, Majelis Hakim memeriksa dan memberikan putusan untuk menerima atau menolak eksepsi bersamaan dengan pokok perkara. Penelitian ini bertujuan untuk mengetahui pertimbangan hukum hakim yang mengabulkan eksepsi gugatan kabur berkaitan dengan bentuk perumusan gugatan pada perkara perdata Nomor 25/Pdt.G/2020/PN.Pbg. serta mengetahui akibat hukum dikabulkannya eksepsi gugatan kabur berkaitan dengan bentuk perumusan gugatan pada perkara perdata Nomor 25/Pdt.G/2020/PN.Pbg. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif. Penelitian ini menggunakan data sekunder yang dikumpulkan dengan melakukan studi kepustakaan yang kemudian dianalisis menggunakan metode normatif kualitatif serta disajikan secara deskriptif. Berdasarkan hasil penelitian, dasar pertimbangan hukum hakim dalam mengabulkan eksepsi yang diajukan tergugat adalah adanya ketidaksesuaian antara fundamentum petendi dan petitum yang diwujudkan dengan penggunaan kalimat negatif dalam petitum sehingga menyebabkan ketidakjelasan hak yang dituntut oleh Penggugat. Akibat hukum diterimanya eksepsi Tergugat adalah Hakim memutus dengan putusan bahwa  gugatan tidak dapat diterima sehingga Hakim tidak mempertimbangkan pokok perkara. Hal tersebut menyebabkan kedudukan para pihak dan status objek sengketa tidak berubah.

Granted Exception of Unclear Lawsuit Related To The Formulation of The Petition (Research Of Verdict Number 25/Pdt.G/2020/PN.Pbg)

ABSTRACT

The exception of unclear lawsuit (Obscuur Libel) that submitted by the defendant can caused by incompleted formal requirements in the lawsuit. Based on the exception submitted by the defendant, The Judges will examine and decide to accept or refuse the exception along with the subject matter of the case. This research aims to find out the judge’s legal consideration in granting the exception of unclear lawsuit related to the formulation of the petition in Verdict Number 25/Pdt.G/2020/PN.Pbg and aims to know the legal consequences because of accepted exception of unclear lawsuit related to the formulation of the petition in Verdict Number 25/Pdt.G/2020/PN.Pbg. This research uses juridic-normative research method with descriptive research specification. This research also uses secondary sources that collected by literature study and analysed by normative-qualitative analysis method and presented by descriptive method. Based on the result of the research, judge’s consideration in granting the exception by the defendant is because there is discrepancy between fundamentum petendi and petition by using negative sentences on the petition that caused ambiguity of the rights that asked by the plaintiff. The legal consequence of the accepted exception is the judges decided by the decision that the lawsuit can not be accepted, so the judges will not consider the subject matter of the case. It caused the parties’ status and the object’s status do not change.
